استهدف هذا البحث إثراء المکتبة الإسلامية بتحقيق کتاب من کتب التراث الإسلامي. وإخراج هذا المخطوط النفيس لطلاب العلم في أبهى حلة، حتى يستفيد منه الباحثون وطلاب العلم. کما کان بحثي في مرحلة الماجستير موضوعاً، فأحببت أن أدخل في مجال تحقيق المخطوطات، حتى أجمع بين الحسنيين، وأکتسب الخبرة المناسبة في المجالين، وتکون حافزاً ومعيناً لي على سلوک الطريقين في المستقبل بالجديد والمفيد. فقد يسر الله لي العثور على أحد هذه الکنوز، وهو مخطوط في أصول الفقه بعنوان "حقائق الأصول" للشيخ حسن بن حسين بن محمد الأملشي، وسأقوم في هذا البحث بتحقيق باب العام والخاص من کتاب حقائق الأصول في علم أصول الفقه، وأسأل الله التوفيق والإعانة في سبيل إخراج هذا المخطوط بشکل لائق يستفيد منه کل من طالعه.
وقد توصلت في ختام هذا البحث إلى نتائج أهمها: أنه يجب العمل باللفظ العام على عمومه، ولا يجوز تخصيصه إلا إذا جاء ما يخصصه، وإذا ورد اللفظ العام على سبب خاص فإن العبرة تکون بعموم اللفظ لا بخصوص السبب، وأن ألفاظ العموم لو اقتصرت على السبب الخاص الذي نزل فيه لتعطلت عامة أحکام الشريعة فإن غالبها نزل لأسباب خاصة، وأَنّ العام الذي أريد به الخصوص ما کان المراد باللفظ أقل، وما ليس بمراد باللفظ هو الأکثر، أي تقصر دلالة العام نفسها على الخاص، والعام المخصوص المراد به هو الأکثر وما ليس بمراد هو الأقل، وأَن التخصيص في العام الذي أريد به الخصوص متقدم على اللفظ، وفيما أريد به العموم وهو العام المخصوص متأخر عن اللفظ أو مقترن به، أَن العام الذي أريد به الخصوص هو ما کان مصحوباً بالقرينة عند التکلم به على إرادة المتکلم به بعض ما يتناوله بعمومه، وهذا لا شک في کونه مجازاً لا حقيقة، لأنه استعمال اللفظ في بعض ما وضع له سواء کان المراد منه أکثره أو أقله، وأما العام المخصوص فهو الذي لا تقوم قرينة عند تکلم المتکلم به على أَنَّه أراد بعض أفراده، فيبقى متناولاً لأفراده على العموم، وهو عند هذا التناول حقيقة
This research aimed at enriching the Islamic library by achieving a book of Islamic heritage. And the production of this precious manuscript for science students in the best suit, so that the benefit of researchers and students of science. As my research in the Masters stage was a subject, I liked to enter in the field of manuscript realization, so that I combine the two good, and gained the appropriate experience in the two fields, and be a catalyst and help me to conduct the two ways in the future new and useful. May Allah be pleased to find one of these treasures, a manuscript in the principles of jurisprudence entitled "Facts of assets" by Sheikh Hassan bin Hussein bin Mohammed Alalmshi, and in this research I will investigate the door of the year The way to produce this manuscript properly benefit everyone who read it.
I have concluded at the conclusion of this research the most imractportant results: that the general word should be applied in general, and may not be allocated only if what is allocated, and if the general word on a special reason, the lesson is the whole of the word not about the cause, and that the words of the public if limited to the cause The special year in which the provisions of the Sharia were disrupted, the majority of them came down for special reasons.
