متى يقدم المفهوم على المنطوق؟ دراسة تأصيلية تطبيقية في بعض مسائل العبادات

هذا البحث يقوم على دعامتين أساسيتين ، وهما: القاعدة الاصولية، والتطبيقات الفقهية، وبيَّن أن قاعدة: "المنطوق يقدم على المفهوم" ليست على إطلاقها.
ويتناول هذا البحث بيان معنى المنطوق وأقسامه والمفهوم وأقسامه، و متى يقدم المفهوم على المنطوق.
وأظهر البحث الارتباط الوثيق بين علم أصول الفقه وعلم الفقه، إذ هو الرکيزة الأساسية له، واعتنى البحث بذکر صورة المسألة وتحرير محل النزاع، وذکر الأقوال معزوَّةً إلى قائليها، مع ذکر أدلة کل قول ومناقشة الأدلة، وذکر الترجيح والتطبيق الأصولي على المسألة.
وقد اشتمل هذا البحث على سبع مسائل، منها: مسألتان في حجية مفهوم، وخمس مسائل في تقديم المفهوم على المنطوق.
And this research is based on two foundational pillars, The Fundamentalist rule and Jurisprudence application. And it shows that the rule “The spoken comes in advance of the understood” is not without restrictions.
And this research elucidates the meaning of the spoken and its types, and the understood and its types, and when to advance the understood over the spoken.
The research shows the firm connection between the principles of Islamic jurisprudence and Islamic jurisprudence, as it is the main pillar for it. And the research took care in mentioning the reality of the issue and editing the subject of the dispute as well as mentioning the sayings attributed to their Sayers. Along with mentioning the evidence of each saying and discussing the evidence. and mentioning the probable and the fundamentalist application of the issue.
And this research contains seven matters. two concerning the validity of the understood, and five in advancing the understood over the spoken
