التبرع للجهات الخيرية غير المسلمة أو من خلالها -دراسة فقهية- Donations to or Through Non،Muslim Charities ، A Jurisprudential Study

يتناول هذا البحث مسائل التبرع للجهات الخيرية غير المسلمة أو التبرع للأفراد من خلالها. يهدف البحث إلى تحرير أحكام هذه المسائل وبيانها، وإيضاح الشروط المتعلقة بها، وذلك للإسهام الفقهي في معالجة النوازل التي قد تواجه بعض المسلمين في العالم الإسلامي أو الأقليات المسلمة في البلدان غير الإسلامية. يستخدم البحث المنهج الوصفي الاستنباطي؛ وذلك بإيضاح الصورة محل البحث، ثم دراسة ما تبنى عليه تلك الصورة من مسائل، ثم استخراج الحكم الفقهي لها منها، واستنباط شروطها منها كذلك. توصل البحث إلى عدد من النتائج، من أبرزها: جواز صدقة التطوع على الجهات الخيرية غير المسلمة بشروط والمنع من الصدقة الواجبة عليها، وجواز التبرع من خلال الجهات الخيرية غير المسلمة إذا كان التبرع لمسلم بشروط، وجواز صدقة التطوع من خلال الجهات الخيرية غير المسلمة على الفرد غير المسلم بشروط والمنع من الصدقة الواجبة من خلالها.
التوصيات : في ختام هذه الدراسة يحسن حث الباحثين والدارسين على العناية وبذل الجهد في دراسة المسائل المتعلقة بتصنيف الشخصية الاعتبارية، وتفصيل الكلام في هذا الجانب.
ولا يفوت التنويه في ختام هذا البحث إلى ضرورة وأهمية مراعاة الأنظمة التي تنظّم التبرعات والالتزام بالتعليمات الواردة في هذا الصدد الصادرة وفق ما تقتضيه السياسة الشرعية من الجهات الرسمية في البلدان الإسلامية
This research addresses the issues of donations to non،Muslim charities or donations made through them to individuals. The research aims to clarify and clarify the rulings on these issues, and the conditions related to them. This is to contribute to the jurisprudential approach in addressing the emerging issues that may face some Muslims in the Islamic world or Muslim minorities in non،Muslim countries. The research uses the descriptive،deductive approach; by clarifying the case in question, then studying the issues upon which that case is based, then extracting the jurisprudential ruling for it, and deriving its conditions from it as well. The research reached a number of conclusions, the most prominent of which are: the permissibility of voluntary charity to non،Muslim charitable organizations, subject to conditions, and the prohibition of obligatory charity from them; the permissibility of donations through non،Muslim charitable organizations, if the donation is to a Muslim, subject to conditions; and the permissibility of voluntary charity through non،Muslim charitable organizations to a non،Muslim individual, subject to conditions, and the prohibition of obligatory charity through them.
Recommendations
In conclusion, this study encourages researchers and scholars to devote careful attention and effort to studying issues related to the classification of legal entities, and to elaborate on this aspect in detail.
In conclusion, this study emphasizes the necessity and importance of observing the regulations governing donations and adhering to the relevant instructions issued in accordance with the requirements of Sharia policy by official bodies in Islamic countries.
