المجمل دراسة أصولية تطبيقية

هذا بحث في المجمل، تناولت فيه تعريف المجمل عند الحنفية وجمهور المتکلمين، وفائدة الفرق بين التعريفين. وتکلمت فيه عن فائدة ورود المجمل في القرآن والسنة. وفرقت بين المجمل واأللفاظ شديدة الصلة به، والتي قد يلتبس على البعض التفرقة بينها وبين المجمل، وذلک في المشکل والعام والمشترک. وتناولت آراء األصوليين في بقاء المجمل بعد وفاة النبي صلى الله عليه وسلم، وانتهيت إلى أنه ال إجمال بعد وفاة النبي صلى الله عليه وسلم فيما فيه تکليف. وبينت ما يتصور فيه اإلجمال من األدلة، وتکلمت عن حکم المجمل، والتزام العمل به قبل البيان، وأقسام المجمل، ومنشأ اإلجمال. وتکلمت عن أسباب اإلجمال عند الحنفية وعند جمهور األصوليين. ووضحت أن اإلجمال کما يکون في األقوال يکون في األفعال. ووقفت مع بعض أسباب اإلجمال المختلف فيها، مثل تردد اللفظ بين المسمى اللغوي والشرعي، وتردد اللفظ بين ما يفيد معنى وما يفيد معنيين، وتردد اللفظ بين المحمل اللغوي والشرعي، وتعذر الحمل على المحمل الشرعي، ثم ذکرت بعض الفروع الفقهية المترتبة على اإلجمال. المجمل دراسة أصولية تطبيقية Research Summary This is research in the field addressed the definition of the Mujmal when the scholar's of Hanafi' and the consensus of the Mutakallimin , I'm already stated that the benefit of the difference between these two streams of scholars, the cost of the benefit receipt of council in the Qur'an and the Sunnah, and about the difference between the proper existence of terminology of Mujmal, Musykil, A'mm and Musytaraq according to Usuluyyin perspectives given the views of the fundamentalists in the existence of Mujmal after the death of the Prophet, peace be upon him, concluded that no summations after the death of the prophet in the assigned... I'm also stated where the whole of the evidence, the judgment based of the Mujmal, and sections of the Mujmal, and the origin of the whole Mujmal, then spoke on the causes of the whole, when you tap all the fundamentalists, and explained that overall, as in the words in acts... I'm also convinced that the factors behind contradictory this terminology within : The frequency of the words between the Language's focal point of views, Shara' or the frequency of the words behind the beneficial meaning of it partially or overalls... I'm also don't forget to mention the frequency of the Mujmal word or terminology based on Language's and Shara' perspective and inability interpretation of this kind of word based on perspective of Shara'...
