الضوابطُ الشرعيةُ في العلاقة بين الجنسين وأثرُها في الاستقرارِ الأسريِّ Sharia Controls on Gender Relations and Their Impact on Family Stability

إن هذا البحثَ يسلط الضوء على أهمية الضوابطِ الشرعيةِ التي وردت في الكتاب والسنة منظمةً ومهذبةً للعلاقة بين الرجل والمرأة، حيث إن
الخالق ﷻ يعلم ما ينصلح به أحوالُ خلقِه؛ فقد جاءتِ الأحكام الشرعيةُ منظمةً لكلِّ جوانبِ العلاقة بين الجنسين، كآداب التعامل، والحقوقِ والواجبات، والحوارِ والتفاهم، وغيرِ ذلك من الأحكام الشرعية والخلقية التي تستقيم بها الأسرةُ وينصلح بها حالُ المجتمع كلِّه.
مما لا شكَّ فيه، أننا في حاجة ماسةٍ إلى ترسيخ هذه الضوابطِ الشرعيةِ، خاصة في هذا العصر الذي نواجه فيها تحدياتٍ بالغةَ الصعوبة، حيث الانفتاحُ الكبير على العالم، وظهورُ وسائلِ التقنيةِ الحديثة التي جعلت شبابَ الأمة يصلون إلى ثقافات المجتمعاتِ الأخرى وعاداتهم وقيمِهم؛ مما يجعلنا أمام تحدٍّ كبير، يوجب علينا الحفاظَ على هويتنا الإسلاميةِ؛ حتى لا تنجرفَ الأمةُ وراء ثقافاتِ الآخرين؛ مما يكون له أثرٌ كبيرٌ في دمار الفرد المسلمِ، ويتبعه دمارُ الأسرةِ ثم المجتمعِ كلِّه.
وبناءً عليه؛ جاء في هذا البحث التأصيلُ للضوابط الشرعية المنظمةِ للعلاقة بين الجنسين داخل الأسرة وخارجَها، وتسليطُ الضوء على الآثار الإيجابيةِ المباركةِ الناتجةِ عن تطبيق هذه الضوابطِ في حياة الأمة، ومن أهم هذه الآثارِ هو الاستقرارُ الأسريُّ، وما يتبعه من أجواء الرحمةِ والمودةِ والتسامحِ وخفضِ الجناح والتغافلِ والصفحِ في المجتمع كلِّه بوجه عام، وداخل الأسرِ بوجه خاص.
This research highlights the importance of the legal controls contained in the Qur’an and Sunnah that organize and refine the relationship between men and women, as the Creator, the Almighty, knows what will improve the conditions of His creation. Therefore, the legal rulings came to organize all aspects of the relationship between the sexes, such as the etiquette of dealing, rights and duties, dialogue and understanding, and other legal and moral rulings that will improve the family and the condition of society as a whole.
There is no doubt that we are in dire need of establishing these legal controls, especially in this era in which we face extremely difficult challenges, with the great openness to the world, and the emergence of modern technological means that have enabled the youth of the nation to access the cultures, customs, and values ​​of other societies. This places us before a great challenge, requiring us to preserve our Islamic identity so that the nation does not drift behind the cultures of others, which would have a major impact in destroying the Muslim individual, followed by the destruction of the family and then society as a whole.
Accordingly, this research aims to establish the legal controls regulating the relationship between the sexes within and outside the family, and to shed light on the blessed positive effects resulting from the application of these controls in the life of the nation. Among the most important of these effects is family stability, and the atmosphere of mercy, affection, tolerance, humility, forgiveness, and pardon that follows in society as a whole, and within families in particular.
