المستخلص

يهدف هذا البحث إلى الوقوف على معنى السلب وأثره في خفاء الدلالة على المعنى المراد الذي هو أحد قسمي دلالات الألفاظ من حيث الوضوح والخفاء، وبيان صورة المسألة، وعرض النص الذي يدل على السلب صراحةً وضمناً، وبيان وجه السلب، وذكر الفروع الفقهية المبنية عليه في كل مطلب.
اتبعت في هذه الدراسة المنهج الاستقرائي، وذلك باستقراء ما ورد في كتب الأصول من كلام عن السلب في خفاء الدلالة وذكر نصوصهم في ذلك صراحة وضمنا، والمنهج الاستنباطي من حيث صورة المسألة، وبيان وجه السلب، والفروع الفقهية المبنية على ذلك.
توصلت من خلال هذه الدراسة إلى جملة من النتائج، ومنها: أن السلب له أثر في القواعد والمسائل الأصولية المتعلقة بخفاء الدلالة مما ينتج عنه أثر في الفروع الفقهية المندرجة تحت تلكم القواعد والمسائل. يوصي الباحث بتناول السلب في مباحث دلالات الألفاظ بقسميها من حيث الوضوح والخفاء، وذلك في المسائل التي لم تُبحث
The current research aims to identify the meaning of negation and its impact on the concealment of the indication of the intended meaning, that is one of the two sections of the meanings of words in terms of clarity and concealment, and to clarify the image of the issue, to present the text that indicates negation explicitly and implicitly, to clarify the aspect of negation, and to mention the jurisprudential branches on which based in each requirement.
In this study, I have adopted the inductive approach, by inducting what was mentioned in the books of fundamentals of jurisprudence about negation in the obscurity of meaning and mentioning their texts in that explicitly and implicitly, and the deductive approach in terms of the form of the issue, explaining the aspect of negation, and the jurisprudential branches has adopted.
I have concluded with a number of findings, including: that negation has an impact on the principles of jurisprudence rules and issues related to the obscurity of meaning, which results in an effect on the jurisprudential branches included under those rules and issues. The researcher recommends addressing negation in the discussions of the meanings of words in its two parts in terms of clarity and obscurity, and that is in the issues that haven’t been researched.
