الاستدلال بسد الذريعة وأثره في تحقيق الأمن الاجتماعي للأقليات المسلمة The inference by blocking the means and its impact on achieving social justice for Muslim minorities

يتناول هذا البحث قاعدة سد الذريعة، التي تعد دليلا شرعيا استنبطها العلماء من نصوص القرآن، والسنة، وعمل بها الصحابة-رضوان الله عليهم-.
 وقد حاولت من خلال هذا البحث التأكيد على أن سد الذرائع قاعدة وأصل مهم من أصول الشريعة الإسلامية، يمكن الاستدلال بها في كثير من الفروع لمنع ما يؤدي إلى محرم، أو منع ضرر أو مفسده، إلا أنه في بعض الأحيان قد يكون في الاستدلال بها تقييد لأمور لم يحرمها الشارع بشكل قطعي صريح، وهذا يؤدي إلى الوقوع في الحرج والمشقة، وقد يؤدي إلى وقوع ضرر على النفس أو المال، وقد حاولت توضيح ذلك من خلال نموذجين:
النموذج الأول: قضية النقاب التي كان للاستدلال بقاعدة سد الذرائع على وجوبه تأثيرا سلبيا على الأمن الاجتماعي للأقليات المسلمة.
أما النموذج الآخر: فهو جواز تضحية المسلمين بغير البقر في الهند وقد كان للاستدلال بقاعدة سد الذرائع على جوازه أثرا إيجابيا، ومحققا للأمن الاجتماعي للأقليات المسلمة.
This research deals with the rule of blocking excuses, which is a legitimate evidence deduced by scholars from the texts of the Qur'an, the Sunnah, and the work of the Companions - Allah be pleased with them -,
I have tried through this research to emphasize that blocking excuses is an important rule and asset of Islamic law, can be inferred in many branches to prevent what leads to forbidden or prevent harm or spoiler, but sometimes it may be in the inference of a restriction of things not forbidden by the street categorically explicitly, and this leads to falling into embarrassment and hardship, and may lead to damage to the soul or money, and I have tried to clarify this through Models:
The first model: the issue of the niqab, in which the inference of the rule of blocking excuses on its obligation had a negative impact on the social security of Muslim minorities.
The other model is the permissibility of Muslims sacrificing non-cows in India, and the inference of the rule of blocking excuses on its permissibility has had a positive impact and achieved social security for Muslim minorities.
