الفتوى عن طريق الذكاء الاصطناعي بين الإقدام والإحجام Fatwa using artificial intelligence Between boldness and reluctance

فمن طلب في القرآن حكم الله لعباده وجده، ومن عمل به استقام أمره، لأنه هو الواضح سبيله، الراشد دليله، الساطع حجته، الواضح محجته، من استضاء بمصابيحه أبصر ونجا ومن أعرض عنها زل وغوى ومن أعرض عن القرآن خسر الدنيا و الآخره.
ثم الصلاة والسلام على نبينا محمد الذي بسنته فصل ماجاء مُجملاً في الكتاب وأظهر ما كان خفياً وقيد ما كان مطلقاً، وأوضح لنا مراد خالقنا من كلامه فتركنا على البيضاء التي قال فيها: «قد تركتكم على البيضاء ليلها كنهارها لا يزيغ عنها بعدي إلا هالك."
أما بعد: فإن الفتوى هي جهاز التنفس للأمة الإسلامية في أنحاء الأرض وازدادت أهميتها في هذا العصر الحديث الذ كثرت فيه التغيرات والنوازل والمستجدات فكان لزاماً وفرض عين على الأمة أن تنصب المجتهدين والمفتين وتهيئتهم ليدلوا الناس على ما فيه صلاح دينهم ودنياهم.
 وأما الذكاء الاصطناعي فهو أمر مستحدث و مصطلح زاد استخدامه أخيرا حتى بات قضية ملحة بين الباحثين والمطورين والمتخصصين في شتى المجالات؛ كأثر للتطور التقني
والتكنولوجي الذي يشهد العالم في مجال تطوير الآلات والروبوتات مما يثير التساؤل حول مدى صلاحيته في هداية الإنسان وتقديم وتقديم الموعظة الحسنة، وعلاقته بمدى إصدار الفتاوى الصحيحة التي تراعى الواقع المتغير، وهل ستتحول «قال الفقهاء» إلى «قال الروبوت أو النظام الآلي».
Whoever seeks in the Qur’an God’s rule for His servants will find it, and whoever acts upon it, his affairs will be set straight, because it is His path that is clear, the right guide its guide, the brightness of its proof, the clarity of its evidence. Whoever is illuminated by its lamps will see and be saved. Whoever turns away from it will slip and go astray, and whoever turns away from the Qur’an will lose this world and the afterlife.
Then blessings and peace be upon our Prophet Muhammad, who, with his Sunnah, explained in general what was stated in the Book, revealed what was hidden, and restricted what was absolute, and made clear to us what our Creator intended from His words, so he left us on the white one in which he said: “I have left you on the white one, whose night is like its day. No one will deviate from it after me except one who perishes.”
As for what follows: The fatwa is the breathing apparatus of the Islamic nation throughout the earth, and its importance has increased in this modern era, in which there have been many changes, calamities, and developments. Thus, it was necessary and imposed on the nation to appoint mujtahids and muftis and prepare them to guide people to what is good for their religion and their world.
 As for artificial intelligence, it is a new matter and a term whose use has recently increased until it has become an urgent issue among researchers, developers, and specialists in various fields. As an effect of technical development
And the technology that the world is witnessing in the field of developing machines and robots, which raises the question about the extent of its suitability in guiding humans and providing and giving good advice, and its relationship to the extent of issuing correct fatwas that take into account the changing reality, and whether “the jurists said” will turn into “the robot or the automated system said.”
