الاجتهاد المقاصدي ودوره في مواجهة التغيرات المناخية Ijtihad Maqssid and its role in confronting climate change

تهدف الشريعة الإسلامية إلى إصلاح المعاش والمعاد، العاجل والآجل، وتربأ بأتباعها من السعي بالإفساد في الأرض بعد إصلاحها، فإن لم يكونوا مصلحين، فلا أقل من أن يكونوا صالحين، ولقد تقرر لدى كل عاقل أن التغيرات المناخية الناجمة عن سلوك بعض البشر، ضررها عظيم على الفرد والمجتمع على حد سواء، ولذا أخذ كل المصلحين على عاتقهم مسؤولية حماية كوكبنا من المخاطر التي تُحدق به من كل جانب، لا سيما مخاطر التغيرات المناخية، وعلى رأس هؤلاء المجتهدين، ومتقلدي مناصب الإفتاء، الموقِّعين عن رب العالمين؛ لذا كان هذا البحث، والذي يهدف إلى إبراز دور الاجتهاد المقاصدي في مواجهة هذه التغيرات المناخية، واتبعت في ذلك المنهج الاستقرائي، حيث تتبعت بعض النوازل التي في المجال البيئي، وخاصة تلك التي لها صلة بالتغيرات المناخية الحادثة؛ لأقف على مدى إمكانية تعظيم الاستفادة من المقاصد الشرعية، وذلك بإعمال المقاصد الكلية في فهم واستنباط الأحكام الشرعية الصحيحة- لهذه النوازل- الملائمة لقصد الشارع، الرَّامي إلى إعمار الأرض والمحافظة على صلاحها، والأخذ على أيد المفسدين وإعادتهم إلى الجادة والطريق القويم، وقد اقتضت طبيعة هذا البحث تقسيمه إلى مقدمة، ومبحثين، وخاتمة، فالمبحث الأول في التعريف بمصطلحات عنوان البحث، والمبحث الثاني في تطبيقات الاجتهاد المقاصدي لمواجهة التغيرات المناخية، والخاتمة؛ وقد اشتملت على بعض النتائج والتوصيات، ومنها: كمال ومرونة الشريعة الإسلامية، ومدى استيعابها لجميع المستجدات وما يطرأ من حوادث ونوازل في كل مناحي الحياة، وأوصيت بضرورة تأصيل فتاوى مواجهة التغيرات المناخية وربطها بمقاصد الشريعة؛ إذ إن هذه المعالجات تنطلق من مبادئ الشريعة الإسلامية وتعاليمها السمحة.
The Islamic Sharia aims at reforming the life and the hereafter, the immediate and the future, and disassociates its followers from seeking corruption in the land after its reformation. The individual and society alike, and therefore all reformers took upon themselves the responsibility to protect our planet from the dangers that beset it from every side, especially the dangers of climate change, and at the head of these mujtahids, and those who hold positions of fatwas, who sign on behalf of the Lord of the Worlds; So this research was, which aims to highlight the role of intentional jurisprudence in confronting these climate changes.And I followed the inductive approach, as I tracked some of the issues in the environmental field, especially those related to the climate changes taking place. To stand on the extent of the possibility of maximizing the benefit from the legal purposes, by implementing the overall purposes in understanding and deriving the correct legal rulings - for these calamities - that are appropriate to the intention of the Lawgiver, which aims to reconstruct the land and preserve its righteousness, and take the hands of the corrupt and return them to the path and the right path.The nature of this research necessitated dividing it into an introduction, two chapters, and aconclusion.the conclusion; It included some results and recommendations, including: the perfection and flexibility of Islamic law, and the extent to which it accommodates all developments and incidents and calamities that occur in all aspects of life. As these treatments stem from the principles of Islamic law and its tolerant teachings.
