القواعد والضوابط الفقهية في كتاب قاموس الشريعة باب الأحوال الشخصية" دراسة استقرائية تطبيقية" Jurisprudential rules and regulations in the book “Dictionary of Sharia,” Personal Status Section, “An Applied Inductive Study”

يتناول هذا البحث الجانب التطبيقي للقواعد والضوابط الفقهية في جانب الأحوال الشخصية من خلال كتاب فقهي موسوعي عُماني ألا وهو "قاموس الشريعة الحاوي طرقها الوسيعة"، فيذكر قواعد وضوابط فقهية متعددة تندرج تحتها فروع عملية كثيرة من الكتاب نفسه، مثل القواعد الخمس الكبرى والضوابط المعروفة في باب الأحوال الشخصية، وانقسم البحث إلى تمهيد -فيه تعريف بالكتاب ومؤلفه والقواعد والضوابط الفقهية المختصة بالأحوال الشخصية-، وستة مطالب فيها تطبيقات للقواعد والضوابط في قسم الأحوال الشخصية. وقد خلص البحث إلى أن كتاب قاموس الشريعة يزخر بالفروع الفقهية الكثيرة المتناثرة التي يمكن إدراجها في القواعد والضوابط الفقهية. وأنه تناول الأحوال الشخصية بتوسع، فأورد فيها الأقوال المختلفة، والمسائل المتنوعة التي يمكن أن ترد إلى قواعدها وضوابطها الفقهية، ونقل عن مصادر فقهية من مذاهب متعددة. وكان من أهم توصياته أن يتناول الباحثون كتاب القاموس بمزيد من الدراسات المعمقة في مصادره ومنهجه، واستخراج القواعد الفقهية الكبرى والصغرى، والقواعد الأصولية والحديثية، وما يتصل بالإيمان والأخلاق والاجتهاد والتقليد والفتوى.
The research deals with the applied aspect of the jurisprudential rules and controls in the personal status aspect through an Omani encyclopedic jurisprudence book, namely, "Qamous Ashria .” It mentions multiple jurisprudential rules and regulations under which many practical branches of the book itself fall, such as the five major rules and well-known controls in the personal status section. The research leads to an introduction that includes an introduction to the book, its author, the jurisprudential rules and regulations, and six demands that include applications of the rules and regulations in the personal status section. The research concluded that "Qamous Ashria  book is full of jurisprudential branches that can be included in the jurisprudential rules and regulations. He dealt with personal status extensively, in which he included various opinions and various issues that could be referred to its jurisprudential rules and controls, and he quoted from multiple sources.One of his most important recommendations was for researchers to study "Qamous Ashria" with more in-depth studies into its sources and methodology, and to extract the major and minor jurisprudential rules, the fundamentalist and hadith rules, and what is related to faith, morals, diligence, imitation, and fatwas.
