الحرية الشخصية ومقاصدها الشرعية من وحي السيرة النبوية Personal freedom and its legal objectives are inspired by the Prophet’s biography

ناقشت الدراسة أكثر المواضيح إلحاحا في هذا الزمان، موضوع “الحرية الشخصية" فعرضتها بعقد مقارنات بين النظم الغربية وبين الشريعة الإسلامية، لكن الجديد في هذه الدراسة أنها وضعت في قالب الهدي النبوي، ومقاصد الشريعة الإسلامية، مبينة الحرية في التصور الإسلامي، والفكر الغربي، وضوابط الحريات، وتطبيقاتها، أوجه الوفاق والفراق،  وقد خلصت إلى أن المقاصد الشرعية في بناء الحرية الشخصية تنطلق من إصلاح البشر وإسعادهم في معاشهم ومعادهم، وتحقيق مراد الله من الخلق، وهو تحقيق العبودية له سبحانه وتعالى، بينما التصور الغربي للحرية الشخصية لم يراع في الحرية الشخصية إلا استحقاق الحقوق والواجبات وكون الإنسان إنسانا، باعتبار أنه هو الحق والمفكر والمشرع للحريات، ليس هناك حق غيره، ومن جهة أخرى، فإن الشريعة الإسلامية ومقاصدها المرعية تتفق مع النظم الغربية وقوانينها المنضبطة على المعاني الإنسانية الراقية والصحيحة التي تجعل من الإنسان يستشعر آدميته وكرامته والتي بدونها تفقد الحياة حيويتها ومضمونها الإنساني، وهناك معان كثيرة في البحث، نحث القارئ النظر إليها.
The research designated a brief study for one of the controversial issues in the modern times, it is “the Personal Freedom”, it demonstrated within the western and Muslim perspectives, from the sight of the prophetic guidance and the Islamic higher Objectives, with a new vision, illustrating the concept of the freedom from the Islamic and the Western perspective, and the certain criteria’s for freedom, moreover its applications, and the aspects of conformity and dissention.
The study declared that the higher objectives of Shari’ah from establishing the personal freedom is aiming at rehabilitation of the humanity and fulfilling their happiness in this life and the hereafter and carrying out the commands of Allah with fully submission to Him.
 In contrast to the western’s perspective for the personal freedom is taking into account only the entitlement to rights and duties and considering the human being is the only one who has the right to think, to legislate, and to enact the laws of freedoms. On the other hand, the Islamic Shariah and its higher objectives are concordant with Western systems and their laws that are governed by human supreme values that make human being feel with his humanity and dignity, without having these, he would lose the objectives of the life and its significance. Therefore, there are many points into the study, we urge the reader just to take a look at the content of it.
