تكمن أهمية الموضوع في اتصال الفقه الظاهري والمالكي بالتراث الفقهي الأندلسي، هذا التراث الذي لم ينل حظه من الدراسة من قبل الباحثين, كما لا يخفى على أحد القيمة العلمية لكتاب "المحلى"، فهو بحق موسوعة فقهية جديرة بالدراسة لما اشتملت عليه من الفقه، ليس فقه ابن حزم وأهل الظاهر فحسب، بل فقه السلف من الصحابة والتابعين والأئمة الأربعة وغيرهم، مع الرد والنقد والمناقشة لتلك المذاهب.
وكان من أسباب اختيار الموضوع منزلة الإمام مالك بن أنس ومرتبته العلمية وهيبته في النفوس، كل ذلك دفعني إلى التفكير في دراسة ما اعترضه عليه الإمام ابن حزم، ليس انتصارا لطرف دون آخر، وإنما لبيان الحق والصواب, ومحاولة جمع وتأصيل المسائل التي عارض فيها الإمام ابن حزم للإمام مالكًا في شروط النكاح.
وهدف البحث إلى معرفة مدى صحة ما نسبه ابن حزم إلى مالك في مسائل شروط النكاح من كتابه المحلى, ومعرفة أسباب الخلاف بين ابن حزم ومالك في مسائل شروط النكاح.
واتبع الباحث المنهـج الاستقرائي, وذلك من خلال تتبع الأقوال والآراء الواردة في المسألة؛ ثم المنهج التحليلي لدراسة تلك النصوص والأقوال وتحليلها وبيان الرأي الراجح وذلك بتتبـع المسائـل التـي اعترض فيها ابن حزم على الإمام مالك في باب النكاح من كتابه المحلى وخطأه فيها.
The importance of the topic lies in the connection between Zahiri and Maliki jurisprudence with the Andalusian jurisprudential heritage, a heritage that has not received much study by researchers. The scientific value of the book “Al-Muhalla” is not hidden from anyone, as it is truly a jurisprudential encyclopedia worthy of study due to the jurisprudence it contains. It is not jurisprudence. Not only Ibn Hazm and the people of al-Zahir, but also the jurisprudence of the predecessors, including the Companions, the Successors, the Four Imams, and others, with refutation, criticism, and discussion of those doctrines.
One of the reasons for choosing the topic was the status of Imam Malik ibn Anas, his academic rank, and his prestige in people. All of this prompted me to think about studying what Imam Ibn Hazm objected to, not as a victory for one party over another, but rather to clarify the truth and correctness, and an attempt to collect and consolidate the issues that Imam Ibn Hazm objected to. He gave the imam a share in the conditions of marriage.
The research aimed to determine the validity of what Ibn Hazm attributed to Malik regarding issues of marriage conditions from his book Al-Muhalla, and to find out the reasons for the disagreement between Ibn Hazm and Malik regarding issues of marriage conditions.
The researcher followed the inductive approach, by tracking the statements and opinions contained in the issue. Then the analytical approach is used to study these texts and sayings, analyze them, and state the most correct opinion by tracing the issues in which Ibn Hazm objected to Imam Malik in the chapter on marriage from his book Al-Muhalla and his mistakes in them.
