الجوانب القانونية للخطأ المهني للمدين المحترف دراسة مقارنة

تهدف هذه الدراسة إلي إلقاء الضوء على الجوانب القانونية للخطأ المهني للمدين المحترف، حيث إن المسؤولية المهنية لا تترتب فقط نتيجة الإخلال بالتزام عقدي احتواه العقد، أو نتيجة للإخلال بالواجب العام المتمثل في واجب الحيطة والحذر والتبصر، إنما تنشأ عن الإخلال بالواجبات المهنية التي تتضمن قواعد المهنة، والتي تُعدُ مصدراً لالتزامات المهنيين المحترفين، وهذه حقيقة عملية تستدعي كسر ذلك الطوق الصلب القائم على ثنائية المسؤولية-عقدية وتقصيرية- في المجال المهني.
ولقد اتبعت في بحثي المنهج الاستقرائي، والاستنباطي في سبيل الوصول لحل لمشكلة الدراسة، واستعمالي للمنهج الاستقرائي في البحث، يظهر في أنني قمت بتتبع الجزئيات التي تكشف عن المبدأ العام للموضوع، أما عن إعمالي للمنهج الاستنباطي، فلأنني اعتمدت على تحليل القواعد العامة الشرعية، والنصوص العامة النظامية التي لها صلة بمشكلة البحث، وحاولت إعمالها وتطبيقها، على المسائل والجزئيات التي يمكن أن تندرج تحتها.

I have followed in my research the inductive and deductive approach in order to reach a solution to the problem of the study, and my use of the inductive method in the research appears in that I have followed the parts that reveal the general principle of the topic, as for my work of the deductive method, because I relied on analyzing the legal general rules and general texts Systematic that is related to the research problem, and I tried to implement and apply it to the issues and parts that may fall under it.
