يتناول البحث معالجة لمشكلة معرفة الخلاف؛ كمصطلح أصولي، وكيفية التعامل معه، وسواء أكان ذلك للمجتهد أو للمقلد، في التفريق بين الخلاف المعتبر وغير المعتبر من جهة، والمعنوي واللفظي من جهة أخرى، وكذا بين خلاف التنوع وخلاف التضاد، كما أنه يسلط الضوء على الاحتجاج به من قبل بعض المقلدين؛ والذين يسوغون الأخذ بما يشاؤون من الأقوال بحجة وجود الخلاف في هذه المسألة أو تلك جهلا أو تشهياً، كما يبيّن كذلك نوعا من القضايا الأصولية المقاربة للاحتجاج بالخلاف؛ كتتبع الرخص، والتلفيق، والتَّخَيُّر من الأقوال، ثم يعرّج على بعض الأثر الذي ينتجه الاحتجاج بالخلاف على بعض المسائل.
The research deals with the problem of knowing the difference; As a fundamentalist term, and how to deal with it, whether it is for the mujtahid or the imitator, in differentiating between the considered and non-considered disagreement on the one hand, and the moral and verbal on the other, as well as between the disagreement of diversity and the disagreement of contradiction, and it also sheds light on the invocation of it by some imitators; And those who justify taking whatever they want from the sayings on the pretext that there is a dispute in this or that issue out of ignorance or appetite, as well as a kind of fundamentalist issues approaching the invocation of the dispute; Such as tracing concessions, fabrication, and choice of sayings, then stopping at some of the impact produced by invoking disagreement on some issues.
