هدفَ البحثُ إلي بيان التزامات مقدمي خدمات التوثيق من حيث الالتزام بالتأكد من دقة مفاتيح التوقيع الإلكتروني وسلامة بيانات شهادة التصديق الإلكتروني، وتوضيح دور الشهادة الإلكترونية في التعامل الإلكتروني . كما ناقشنا التزام جهة التوثيق بالمحافظة على سرية بيانات التوثيق . كما بينا مدي التزام جهة التوثيق بوقف الشهادة الإلكترونية مؤقتاً أو إلغائها ، ولطبيعة البحث اُتُّبِعَ المنهج المقارن، وذلك بعرض موقف أكثر من تشريع محلي ودولي وإجراء دراسة تحليلية ، كذلك استخدم الباحث المنهج التحليلي بتناول كل جزئية بعد تحليلها من خلال الآراء الفقهية والقوانين الوطنية ، وذلك بتطبيق المنهج الوصفي عند إيضاح بعض المفاهيم التي تتضمن تحليلاً دقيقاً للمعلومات والحقائق عن موضوع الدراسة.
وقد خرج البحث بعد عرض مادته بعدة نتائج، منها: أن خدمات التوثيق الإلكتروني هي الوسيلة القانونية لبعث الثقة وتأمين التعامل عبر الإنترنت ، واستناداً للنتائج قدم الباحث جملة من التوصيات منها التوصية بإصدار تشريع شامل ينظم الدور الذي يقوم به الغير محل الثقة في مجالات التوقيع الإلكتروني، والبريد الإلكتروني الموصي عليه ، والحفظ الإلكتروني .
The aim of the research is to demonstrate the commitments of authentication service providers to ensure the accuracy of the e-signature keys, certification safety of the e-authentication data, and clarifying e-certificate role in e-transactions. The research also discussed the authentication body’s commitment to maintain the confidentiality of authentication data. It also showed the extent of the authentication party’s commitment to temporarily suspension or cancellation of the e-certificate. Based on the nature of the research, the comparative approach was followed by presenting the attitude of more than one local and international legislation and conducting an analytical study. The researcher also used the analytical method by addressing each part after analyzing it through jurisprudential opinions and national laws via the descriptive approach implementation when clarifying some concepts that include accurate analysis of information and facts about the subject of study.
The research came out, after presenting its material, with several results, including: e-authentication services are the legal means to send confidence and secure online transactions. Based upon the results, the researcher made a set of recommendations, including: the recommendation to issue a comprehensive legislation that regulates the role played by trustworthy third parties in the fields of e-signature, recommended e-mail, and e-filing.
