الأسس الشرعية لمفهوم العدل بين الرجل والمرأة وصور إرسائه بينهما

هدفت الدراسة تناول الأسس الشرعية لمفهوم العدل بين الرجل والمرأة وبيان صور إرسائه بينهما، ولتحقيق هذا الهدف تم استخدام المنهج الاستنباطي، وجاءت الدراسة مکونة من تمهيد شمل المقدمة ومبررات الدراسة ومنهجها والدراسات السابقة ومخططها، ثم ثلاثة مباحث على النحو التالي: المبحث الأول: مفهوم العدل، وفيه ثلاثة مطالب: المطلب الأول: مفهوم العدل في اللغة، المطلب الثاني: مفهوم العدل في الشريعة الإسلامية، المطلب الثالث: مفهوم العدل في القانون، المبحث الثاني: الأسس الشرعية التي يقوم عليها مفهوم العدل بين المرأة والرجل، وفيه خمسة مطالب: المطلب الأول: الأصل المساواة ما لم يأتِ الدليل على خلاف ذلک، المطلب الثاني: العدل لا يعني المساواة المطلقة، المطلب الثالث: الموازنة بين الحقوق والواجبات، المطلب الرابع: أدوار المرأة والرجل مبنية على التکامل لا على التزاحم، المطلب الخامس: أصل التعامل بين المرأة والرجل دائر بين العدل والفضل، المبحث الثالث: صور إرساء العدل بين المرأة والرجل، وفيه مطلبان: المطلب الأول: المساواة في الاستحقاق مالم يأتِ الدليل بخلافها، المطلب الثاني: الموازنة بين الاستحقاق والتحمل المالي.
The study aimed to address the legal foundations of the concept of justice between men and women and to show the images of its establishment between them. To achieve this goal, the deductive approach was used. It contains three demands: the first requirement: the concept of justice in the language, the second requirement: the concept of justice in Islamic law, the third requirement: the concept of justice in law, The second topic: the legal foundations on which the concept of justice between women and men is based, and it contains five demands: The first requirement: the principle of equality unless evidence comes to the contrary, the second requirement: justice does not mean absolute equality, the third requirement: the balance between rights and duties, the fourth requirement The roles of women and men are based on complementarity, not competition. The fifth requirement: The origin of the interaction between women and men revolves between justice and grace. The third topic: Images of establishing justice between women and men, and there are two demands: The first requirement: equality in entitlement unless evidence comes to the contrary, the second requirement Balance between maturity and financial endurance.
