الترجيح بالضرورة وأثره في الفتاوي المستجدة

إن مما يضبط أحکام الفقه وييسر فهمها، ويسهل استحضارها معرفة القواعد الفقهية والإحاطة بها؛ إذ إن القاعدة الفقهية حکم کلي أو أغلبي ينطبق على جميع جزئياته، وحيث أمکن للفقيه معرفة هذا الحکم سهل عليه استحضار أحکام جميع الفروع التي تندرج تحته، وبذلک يتيسر فهم الشريعة، وضبط المسائل الفقهية، وربطها بأصولها وقواعدها، فلا يقع ما يبدو أنه تعارض
أو اضطراب وحيث عرف طالب العلم هذه القواعد سهل عليه أيضاً إدراک مقاصد الشريعة وأصولها العامة، وتکونت لديه الملکة الفقهية التي يرتقى بها في النظر والاجتهاد، وهي مرتبة عالية وغاية سامية للوصول إليها.
والعمل بالضرورة من الأمور التي تؤکد شمولية هذه الشريعة، وتقرر صلاحيتها لکل زمان ومکان، ومواکبتها للأحوال المتغيرة، وفيه تيسير للعباد ورعايًة لمصالحهم ودرًأ لمفاسدهم، وهذا يعتبر من أهم أهداف الشريعة ومقاصدها، شريطة أن يکون مقيدا بضوابط تحفظ مقاصد الشريعة وتحققها، فالعمل بالضرورة مشروع في حدود مقاصد الشرع ومراميه النبيلة .

Or confusion, and since the student of knowledge knows these rules, it is also easy for him to understand the purposes of Sharia and its general principles, and he has the jurisprudential faculty with which he rises in consideration and ijtihad, which is a high rank and a lofty goal to reach.
Action by necessity is one of the things that confirms the comprehensiveness of this Sharia, and decides its validity for every time and place, and keeps pace with changing conditions, and it facilitates the people and takes care of their interests and ward off their evils.
