المرتکزات الأصولية للإجراءات الاستثنائية المتعلقة بفيروس کورونا- دراسة أصولية تحليلية

عنوان البحث: (المرتکزات الأصولية للإجراءات الاستثنائية المتعلقة بفيروس-دراسة أصولية تحليلية). وهو متعلق بمسألة مهمة، وهي القواعد الأصولية التي تنطلق منها الإجراءات الاستثنائية التي اتبعتها الحکومات بشأن تفشي فيروس کورونا.
وهي مسألة مهمة من المسائل المطروحة الآن بقوة على ساحة البحث العلمي؛ نظراً لقيام حائجة کورونا وانتشارها وعمومها في أقطار العالم المختلفة. وقام الباحثون بدراسة کل ما يحيط بهذه الجائحة ومدى تأثيرها في جميع مناحي الحياة الصحية والاقتصادية، والتعليمية وغيرها.
وقد اتبعت الحکومات مجموعة من الإجراءات حفاظاً على حياة رعاياها ومواطنيها من هذا الفيروس ولمواجهة تفشيه، وتعتبر هذه الإجراءات أموراً استثنائية على خلاف القواعد والعامة والأحکام الأصلية.
والناظر في الشريعة الإسلامية –حفظها الله- بقواعدها وأحکامها يدرک إدراکاً تاماً مدى رعاية وحفاظ الشرع الحنيف على حياة المکلفين وصحتهم.
   وفي هذا البحث يحاول الباحث إلقاء الضوء على القواعد الأصولية التي تعتبر منطلقاً للإجراءات الاستثنائية ومنها الإجراءات المتخذة لمواجهة تفشي فيروس کورونا، وذلک في ثلاثة فصول: الأول: الحکم الشرعي وعلاقته بالإجراءات الاستثنائية المتعلقة بفيروس کورونا. الفصل الثاني: الأدلة الشرعية وعلاقتها بالإجراءات الاستثنائية المتعلقة بفيروس کورونا. الفصل الثالث: المقاصد الشرعية وعلاقتها بالإجراءات الاستثنائية المتعلقة بفيروس کورونا.
وقد استعمل الباحث المنهج الاستقرائي التحليلي فيما يتعلق باستقراء القواعد الأصولية التي تعتبر أساساً للأحکام الاستثنائية، وتحليل مدى ارتباط هذه القواعد الأصولية بالإجراءات الاستثنائية المتعلقة بمواجهة فيروس کورونا. .
وتوصل الباحث إلى عدة نتائج لعل أهمها: أن الشريعة الإسلامية تمتلک أسباب الخلود والبقاء بقواعدها ومقاصدها التي تجعلها صالحة لکل زمان ومکان. وأن الشريعة الإسلامية فيها القواعد الأصولية ما هو أساس ومنطلق للأحکام الشرعية غير العادية. رابعاً: مدى رعاية الشريعة الإسلامية لمصالح المکلفين في العاجل والآجل. وأن الحکم الشرعي والأدلة الشرعية ومقاصد الشارع لها علاقة وثيقة بالإجراءات الاستثنائية لفيروس کورنا.
Research title: (Fundamentals of Fundamentalism for Exceptional Measures in Islamic Law, Corona Virus as a Model). It is related to an important issue, which is the fundamental rules from which the exceptional measures taken by governments regarding the outbreak of the Corona virus are based.
It is an important issue that is now being actively discussed in the scientific research arena. Due to the outbreak of the Corona virus and its spread and generality in different countries of the world. The researchers studied everything surrounding this pandemic and its impact on all aspects of health, economic, educational and other aspects of life.
Governments have followed a set of measures to preserve the lives of their nationals and citizens from this virus and to confront its spread, and these measures are considered exceptional matters in contrast to the original rules, general and provisions.
The observer of Islamic Sharia - may God preserve it - with its rules and provisions, is fully aware of the extent of the care and preservation of the true Sharia on the lives and health of those charged.
In this research, the researcher attempts to shed light on the fundamentalist rules that are considered as a starting point for exceptional measures, including the measures taken to confront the outbreak of the Corona virus, in three chapters: The first: the legal ruling and its relationship to the exceptional measures related to the Corona virus. Chapter Two: Forensic evidence and its relationship to the exceptional measures related to the Corona virus. Chapter Three: Legitimate Objectives and their Relationship to the Exceptional Measures Related to the Coronavirus.
The researcher reached several results, perhaps the most important of them: that Islamic Sharia possesses the reasons for immortality and survival with its rules and purposes that make it valid for every time and place. And that Islamic Sharia has fundamental rules that are the basis and starting point for the extraordinary legal rulings. Fourth: The extent to which Islamic Sharia takes care of the interests of the taxpayers in the immediate and the future. And that the legal ruling, the forensic evidence and the intentions of the street have a close relationship with the exceptional measures of the Corna virus. God knows
