التخصيص بالعقل

مما لا شک فيه أن فهم الدين ومقصود الشارع يتوقف على فهم النصوص الشرعية ، ولا سبيل إلى فهم معناها فهما صحيحا يؤهل إلى استنباط الأحکام إلا بالتعرف على المعاني التي وضعت الألفاظ لإفادتها من حيث عمومها وخصوصها وإطلاقها وتقييدها وغير ذلک . وإن مورد التکليف هو العقل ، حتى إذا فقد ارتفع التکليف رأسا ، ولما کان علم أصول الفقه هو العلم المعني بوضع قواعد استنباط الأحکام الشرعية من أدلتها التفصيلية بطرق وأسس علمية صحيحة ، وهو العلم الذي يؤسس لاستعمال العقل في الشرع ، فللعقل دور في فهم الوحي قرآنا وسنة وکذلک معرفة دلالات الألفاظ کان من الهام دراسة موضوع يجمع بين دلالات الألفاظ ودور العقل فيها فجاء موضوع بحثي بعنوان (التخصيص بالعقل) وخلاف الأصوليين في التخصيص بالعقل خلاف لفظي - على الرأي الراجح - فإن الجميع متفق على أن ما خصصه العقل غير داخل في عموم اللفظ إلا أن البعض لا يسميه تخصيصا .
There is no doubt that the understanding of religion and the intent of the legislator depends on understanding the legal texts, and there is no way to understand their meaning in a correct manner that qualifies to derive rulings except by identifying the meanings that have been put in words to benefit them in terms of their generality, specificity, release, and restriction, and so on. And the source of the assignment is the mind, even if the assignment is raised upside down, and since the science of jurisprudence is the science concerned with setting the rules for deducing legal rulings from their detailed evidence with correct scientific methods and foundations, and it is the science that establishes the use of reason in the law. The mind has a role in understanding the revelation of the qur’an and sunnah, as well as knowing the semantics of words. It was important to study a topic that combines the semantics of words and the role of the mind in them, so a research topic came under the title (specialization with the mind). And the disagreement of the fundamentalists regarding the singling out of reason is a verbal disagreement - according to the most correct opinion - all agree that what the mind has specified is not included in the generality of the expression, except that some do not call it specialization.
