القواعد الفقهية عند الصحابة رضي الله عنهم الاستمداد والاحتجاج

مصادر الاستدلال في الشريعة المطهرة أصلها الکتاب الکريم والسنة النبوية المطهرة ، ثم ما يتبعهما من مصادر تبعية تابعة لهما جاء الأمر بهما على اعتبارها والاستدلال بها بعد الکتاب والسنة ، ومن هذه المصادر قول الصحابة رضي الله عنهم. ويتفق العلماء على وجوب الاحتجاج بصور من أقوالهم کما يتفقون على عدم إعمال صور أخرى ، وتظل بعض الصور محل خلاف وسعة بين العلماء رحمهم الله . وعلى القول بحجية الصحابة – في صور الاتفاق وصور الخلاف عند من يقوله بالصورة – يتعين القول بأن الاحتجاج عام ليس مقصوراً على الفروع ، بل کان دأب السلف اعتبار أقوالهم في کل شؤون الشريعة العقيدة والأحکام بأصولها وفروعها. ومن علوم الشريعة التي يستدل لها بأقوال الصحابة رضوان الله عليهم القواعد الفقهية . وهذا البحث حاول ان يؤصل قضية الاستدلال بما يصدر عن الصحابة رضي الله عنهم من القواعد الفقهية من أقوالهم الدالة أو أفعالهم وتطبيقاتهم في الإفتاء والقضاء أو في السياسة الشرعية عند الخلفاء الأربعة رضي الله عنهم أجمعين ، فتکلم البحث عن عموم الاحتجاج بقولهم في الأصول والفروع ، وعن أثر القواعد الفقهية في اجتهاد الصحابة ، وعن مجالات استمدادها من مصادر علم الصحابة ، وکل هذا بالاستدلال والتمثيل .
The sources of inference in the pure Sharia are rooted in the Holy Book and the purified Sunnah of the Prophet, then what follows them from the subordination sources that follow them. Scholars agree on the necessity of invoking images of their sayings, just as they agree that other images should not be used, and some images remain a subject of widespread disagreement among scholars, may God have mercy on them. According to the argument of the Companions - in the forms of agreement and the forms of disagreement among those who say it in the form - it must be said that protest is general and is not limited to branches, rather the practice of the predecessors was to consider their sayings in all matters of Sharia belief and rulings with its origins and branches. Among the sciences of Sharia that are inferred from the sayings of the Companions, may God be pleased with them, are the jurisprudence rules. This research tried to establish the issue of inference with the jurisprudential rules issued by the Companions, may God be pleased with them, from their indicative sayings or actions and their applications in fatwas, judiciary or legal politics of the four caliphs, may God be pleased with them all. The jurisprudential rules in the Ijtihad of the Companions, and about the areas of derivation from the sources of the Companions’ knowledge, and all this by inference and representation.
