تغير الفتوى بتغير الأحوال والأزمنه وبعض تطبيقاتها المعاصرة ( منطقة حائل نموذجا )

قاعدة تغير الفتاوى والأحکام بتغير الزمان والمکان من القواعد الفقهية المهمة التي تناولها علماء الشريعة والفقه على مختلف مذاهبهم وتنوع مشاربهم في کتبهم ومؤلفاتهم بالتأسيس والتفريع والتطبيق ، وهي من أهم القواعد التي يرتکز عليها النظر الفقهي المعاصر في الاستدلال والاستنباط للقضايا المستجدة في شتى الفروع والمجالات ، إلا أن هذه القاعدة جرى حولها جدل وأثيرت في حقها شبهات ممن يعمل في حقل الفتوى والعلم بين طائفة ترفض هذه القاعدة وتعتبرها تحريفا للدين وتغييرا لأحکامه الثابتة وبين طائفة أخرى تحملها على ظاهر معناها فتنطلق الى جميع مجالات الشريعة وأحکامها بالتغيير والتبديل لمجرد تغير الزمان وتبدل الأحوال والظروف. والبحث يسلط الضوء على مفهوم هذه القاعدة بتحرير محل النزاع من خلال نصوص القرآن والسنة وأقوال الفقهاء ، متبوعا بنماذج من القضايا المعاصرة التي تغيرت فيها أنظار الفقهاء والمجتهدين لتغير مناط الحکم عما کان عليه الحال في العصور الغابرة وذلک من خلال مجتمع مدينة حائل بالمملکة العربية السعودية. 
The rule of changing fatwas and rulings with the change of time and place is one of the important jurisprudence rules that scholars of Sharia and jurisprudence dealt with on their various schools of thought and the diversity of their attitudes in their books and writings in terms of foundation, branching and application, It is one of the most important rules on which contemporary jurisprudential consideration is based on inference and deduction for emerging issues in various branches and fields.However, this rule has been debated and suspicions have been raised against it by those who work in the field of fatwa and science between a group that rejects this rule and considers it a distortion of religion and a change of its established rulings, and another group that carries it on its apparent meaning and goes to all areas of Sharia and its provisions with change and alteration just because of the change of time and the change of conditions and circumstances.The research sheds light on the concept of this rule by liberating the subject of dispute through the texts of the Qur’an and Sunnah and the sayings of jurists, followed by examples of contemporary issues in which the attention of jurists and mujtahids has changed to change the framework of governance from what was the case in ancient times, through the community of the city of Hail in the Kingdom of Saudi Arabia.
