الغش التجاري وسبل القضاء عليه في الفقه الإسلامي

يهدف البحث إلى دراسة موضوع الغش التجاري ووسائل القضاء عليه في الفقه الإسلامي لکونه من المخالفات الشرعية التي يتکرر حدوثها في جميع القرون والأماکن والأزمان. ويزداد انتشاراً في الآونة الأخيرة. ويرجع ذلک إلى عدم وضوح أحکام بعض المعاملات المستجدة عند البعض أو بسبب اتباع الهوى والحرص وشدة الطمع في الدنيا ولذاتها. والغش من القضايا التي يحتاج الناس إلى مزيد من التفصيل من ناحية أحکامها وضوابطها؛ وهذا من أهم ما تهدف إليه هذه الدراسة المتواضعة. المنهج المستخدم؛ المنهج الاستقرائي والتحليلي؛ أما المنهج الاستقرائي فقد تم استخدامه في استقراء أهم الأحکام ذات الصلة بالموضوع؛ کما تم استخدام المنهج التحليلي في تحليل ما يحتاج إلى التحليل من أهم القضايا المتعلقة بالموضوع. وخلُصت الدراسة إلى العديد من أهم الوسائل التي تعلب دوراً فعَّالاً في القضاء على الغش التجاري.
The research aims to study the issue of commercial fraud and the means of eliminating it in Islamic jurisprudence. As it is one of the Sharia violations that occur repeatedly in all centuries, places and times. In addition, it is getting more and more common in recent times. This is due to the lack of clarity of the provisions of some new transactions for some, or due to the following of whims and desires, and the intensity of greed in the world and for itself. Moreover, fraud is one of the issues that people need more detail in terms of its provisions and controls. This is one of the most important aims of this modest study. The curriculum used; Inductive and analytical approach; as for the inductive approach, it was used to extrapolate the most important judgments related to the topic. The analytical method was also used in analyzing the most important issues related to the topic that needed to be analyzed. The study concluded with many of the most important methods that play an effective role in eliminating commercial fraud.
