الإرادة المنفردة للمرأة في الطلاق بين الحنفية والمالکية دراسة مقارنة

العلاقة الزوجية ترتکز على المودة والرحمة بين الطرفين، وذلک لقوله تعالى:﴿ وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَکُمْ مِنْ أَنْفُسِکُمْ أَزْوَاجًا لِتَسْکُنُوا إِلَيْهَا وَجَعَلَ بَيْنَکُمْ مَوَدَّةً وَرَحْمَةً إِنَّ فِي ذَلِکَ لَآيَاتٍ لِقَوْمٍ يَتَفَکَّرُونَ﴾[الروم:21]، فإذا کانت الحياة بين الزوجين على هذا الأساس، يمکن أن تکون طبيعية ومستمرة، سواء أکان الاستمرار ناشئًا عن التعاون بينهما في تحقيق ذلک، أو من تضحية أحدهما بمزاجه وسلوکه لمصلحة الفريق الآخر، وٕالا بإمکانهما أن ينفصلا، ويبدأ کل واحد منهما حياة جديدة باعتبار ذلک ضرورة حياتية.
وکما أباحت الشريعة الإسلامية حق الزوج في طلاق زوجته والذي أخذ به قانون الأسرة، أباحت للزوجة أيضا هذا الحق، لکن بطريقة تختلف عن طلاق الزوج.

Just as Islamic Sharia permits the husband's right to divorce his wife, which was adopted by the family law, it also allows the wife this right, but in a manner that differs from the husband's divorce.
