المستجدات الفقهية وأثرها في الزواج والطلاق

القطع بثراء الفقه الإسلامي وتنوعه، وأنه ليس ضئيل الحجم أو سطحي الغوص، کما يدعي الکثير من المستشرقين وتلاميذهم الحاقدين البلهاء، ومعالجة قضايا العصر ومشکلاته ووقائعه المستجدة؛ فلکل عصر قضاياه ومشکلاته ووقائعه المتجددة التي لم يتکلم عنها الفقهاء السابقون، وإخضاع مسألة الفحص الطبي قبل الزواج وإدراجها ضمن باب السياسة الشرعية، وفي حالة انتشار الأمراض الوراثية والمعدية في بلدٍ معين، وکان الزواج من أهم الأسباب التي تؤدي إلى انتشار تلک الأمراض، فإن لولي الأمر التدخل في ذلک، وله أن يجعل الفحص الطبي قبل الزواج إلزامياً، وذلک لحماية أفراد المجتمع من الأمراض المستعصية، وحمايتهم صحياً ونفسياً واجتماعياً وغير ذلک، وأما في الحالات العادية؛ التي لا يکون فيها الزواج سبباً لانتشار الأمراض الوراثية والمعدية، فإنه من غير اللائق أن يلزم الناس بإجراء الفحص الطبي قبل الزواج، لأنه فيه مشقة وصعوبة، وجرت العادة والحمد لله سنين طويلة أن الناس يتزوجون من دون الفحص الطبي والغالب السلامة، والقرائن الطبية المعاصرة القوية حجة في الإثبات ، يجوز العمل بها ، والحکم بمقتضاها .

In evidence, it is permissible to work with it, and to rule accordingly.
