تقدير الديات في الفقه الإسلامي

لقد کان من تمام کرم الله تعالى على الأمة أن جعل لها شرعا وافيا بحاجات العباد وتحقيق مصالحهم في کل واقعة تعن أو نازلة تحدث، فليست تنزل بأحد من أهل دين الله نازلة إلا وفي کتاب الله الدليل على سبيل الهدى فيها.
ومن هذا تشريعه سبحانه لموضوع الديات وتحديدها بحد فاصل يرفع النزاع بين أولياء القاتل والقتيل، ونظرا؛ لأن التشريع الإسلامي للدية کان في أموال مملوکة للعرب بکثرة کالإبل والدنانير والدراهم وهذا يتوافق مع الناس في زمن التشريع، وبما أن الشريعة وافية لجميع الأحکام في جميع الأعصار فلقد رأيت بيان قيمة الدية بالعملة الحالية تيسيرا على الناس، وإثباتا لقيمة الدية في القتل من خلال هذا البحث والذي جاء عنوانه: (تقدير الديات في الفقه الإسلامي)، وفي نظري أنه يعد إسهاما مهما في جانب من جوانب الفقه الإسلامي تبين مدى وفاء الشريعة بمتطلبات الحياة ومستجداتها التي تعرض وتحتاج إلى النظر من جانبي التقويم، والتقدير.
It was one of the utmost generosity of Allah Almighty upon the Islamic Ummah, that He provided us the sufficient Sharia that is for the needs of the servants of Allah, and to achieve their interests in every incident or calamity that occurs . So every event goes down to one of the servants of Allah, except in the Qur’an evidence of it .
And from this, His Almighty legislation of the issue of blood money for the dead man and defining it as final limit that removes the conflict between the guardians of the murderer and the murdered . And given that the Islamic legislation on blood money was in The famous Arab money , such as camels, Dinars and Dirhams. And since the Sharia is adequate for all provisions of all ages , I have seen an explanation of the value of blood money in the current currency, in order to facilitate the people, and to prove the value of blood money in killing through this research , which is titled: ( Estimating blood money in Islamic jurisprudence). In my opinion, it is an important contribution to an aspect of Islamic jurisprudence, which demonstrates Sharia fulfillment of the requirements of life and its developments that occur and need to be considered from both sides of the estimating and value.
