لقد منح الإسلام المرأة کافة الحقوق ، مثلها في ذلک مثل الرجل ، ولم ينقص من حقها کونها امرأة ، والناس في هذا العصر في حاجة إلى دراسة متعمقة لفهم القرآن الکريم ، والسنة النبوية لنرى الرعاية الإلهية لهذا الکائن اللطيف ؛ ونرد الشبهات والنداءات التي اتخذها بعض أدعياء تحرير المرأة التي تزعم قسوة الأحکام ورجعيتها تحت دعوى التحرر والمدنية، وکذلک ما فعله أعداء الدين وسيلة للطعن في الإسلام واستقطاب المرأة وإبعادها عن تعاليم ربها ونبيها ، ومن أجل ذلک تراهم يثيرون مطاعن عديدة للزج بالمرأة المسلمة في مهاوي النزاع مع تعاليم الإسلام ، وللأسف نجد مطاعنهم وأساليبهم تصادف رغبة من بعض سفهة العقول ، من أجل ذلک کان هذا الموضوع واجب وقت؛ حيث کان من الواجب تسليط الضوء على الدستور القرآني أثناء تشريعه لحقوق المرأة کما بينها الخالق الکريم ، وکما فسرها خاتم النبيين ، لذا کان بحثي في بيان تولي المرأة القضاء بين الفقه والقانون".
