ترتيب الأدلة وأثره في الترجيح عند الحنابلة

إن هذا البحث الذي بين يدي القارئ والمعنون بـ (ترتيب الأدلة وأثره في الترجيح عند الحنابلة) قد تکلمت فيه عن حقيقة الترتيب بين الأدلة والمراد به في أصول الفقه وحکمه، وبينت اهتمام علماء أصول الفقه بهذا الموضوع وأثره في هذا الفن، ومن ذلک أثره في الترجيح بين الأدلة التي يظهر للمستدل التعارض فيما بينها، وقد تناولت فيه تعريف: التعارض، الترجيح، الأدلة، ترتيب الأدلة وأهميته والفرق بينه وبين ما يقاربه من مصطلحات، ومن هو القائم بعملية الترتيب.ثم بينت أصول الإمام أحمد رحمه الله وترتيبها في المذهب الحنبلي، وأثر ذلک في المرجحات في المذهب الحنبلي، سواء کان في المرجحات من حيث السند، أو من حيث المتن، أو من حيث المدلول، أو في المرجحات الخارجية أو في مرجحات القياس.
This research, which is in the hands of the reader, entitled (Arranging the Evidence and Its Effect on Predisposition according to the Hanbalis), in which I spoke about the reality of the arrangement between the evidence and what is intended in the principles of jurisprudence and its ruling, and showed the interest of the scholars of jurisprudence in this subject and its impact on this art, including its effect on weighting. Among the evidences that appear to the inferred conflict between them, and I dealt with the definition of: the contradiction, the weighting, the evidence, the order of the evidence and its importance and the difference between it and what is close to it in terms of terms, and who is in charge of the arrangement process.
Then I showed the origins of Imam Ahmad, may God have mercy on him, and their arrangement in the Hanbali school of thought, and the impact of that on the weights in the Hanbali school, whether it was in the weights in terms of the bond, or in terms of the text, or in terms of meaning, or in the external weights or in the weights of measurement.
