القواعد الأصولية وتطبيقاتها على الأحکام المتعلقة بوباء کورونا

هذا بحث بعنوان: "القواعد الأصولية وتطبيقاتها على الأحكام المتعلقة بوباء كورونا" وقد تناولت في هذا البحث مجموعة من القواعد الأصولية، ثم ذكرت الفروع الفقهية المتعلقة بوباء كورونا المندرجة تحت هذه القواعد.
 والقواعد التي تناولتها هي:  قاعدة: كل حكم شرعي أمكن تعليله تعين تعليله والقياس جائز فيه، وقاعدة: القياس في الرخص، وقاعدة: الإعمال أولى من الإهمال، وقاعدة: سد الذرائع والأخذ بأسباب الوقاية، وقاعدة: دلالة الاقتران، وقاعدة: الأصل في أفعال النبي صلى الله عليه وسلم العموم إلا ما دل الدليل على اختصاصه به، وقاعدة: حفظ النفس ضرورة ومقصد شرعي، وقاعدة: حفظ النفس مقدم على أداء فروع الدين، وقاعدة: تصرف الإمام على الرعية منوط بالمصلحة، وقاعدة: سلطة ولي الأمر في تقييد المباح، وأخيرا قاعدة: يشترط في التكميلي ألا يعود على الأصل بالإبطال.
والمنهج المتبع في هذا البحث هو المنهج الاستقرائي من جهة جمع المادة العلمية واختيار المسائل، وكان اختياري للمسائل قائما على أساس أهمية المسألة ومدى الحاجة إلى معرفة حكمها الشرعي، واتبعت المنهج التحليلي من جهة النظر في الأدلة والموازنة بين أقوال العلماء. ومنهجي في عرض المسائل هو الابتداء بذكر القاعدة ثم القيام بتأصيلها، وبعد ذلك أذكر ما يندرج تحتها من فروع فقهية تتعلق بوباء كورونا.
ومن النتائج التي انتهى إليها البحث إثبات صلاحية الشريعة الإسلامية لكل زمان ومكان واستيعابها لما يواجه الناس من نوازل في زماننا. ومن التوصيات العناية بالرجوع إلى آراء مؤسسات الاجتهاد الجماعي وقراراتها في دراسة مسائل النوازل مع رعاية فقه الواقع ومقاصد الشريعة الإسلامية.
This is a research titled “Fundamental Rules and Their Applications to Rulings Related to the Corona Epidemic.” In this research, I talked about a group of fundamentalist rules, then I mentioned the branches of jurisprudence related to the Corona epidemic that fall under these rules, and the rules that I studied are:Rule: Every legal ruling that can be explained must be explained, and analogy is permissible in it. Rule: Analogy in concessions. Rule: Action is better than neglect. Rule: Closing pretexts and taking precautions. Rule: Connotation of conjunction. Rule: The principle in the actions of the Messenger, may God bless him and grant him peace, is generality. Except for what the evidence indicates that he is specialized in it, and the rule: preserving oneself is a necessity and a legitimate goal, and the rule: preserving oneself takes precedence over performing the branches of religion, and the rule: the ruler’s action over the subjects is dependent on the interest, and the rule: the authority of the ruler to restrict what is permissible, and finally the rule: one of the conditions for supplementation. That the cancellation does not affect the original.
The approach followed in this research is the inductive approach in terms of collecting scientific material and selecting the issues. My selection of the issues was based on the importance of the issue and the extent of the need to know its legal ruling. I relied on the analytical approach in terms of looking at the evidence and balancing the statements of the scholars. My methodology in presenting the issues is to begin by mentioning the rule, then rooting it, and after that I mention the branches of jurisprudence that fall under it related to the Corona epidemic.
Among the results of the research is proof of the validity of Islamic law for every time and place and its understanding of the realities people face in our time. Among the recommendations is to pay attention to the opinions of collective ijtihad institutions and their decisions in studying issues of new facts, while taking care of the jurisprudence of reality and the goals of  Sharia.
