موانع النظر القضائي في الفقه الإسلامي دراسة مقارنة بالنظام السعودي

يهدف هذا البحث الموسوم بموانع النظر القضائي في الفقه الإسلامي دراسة مقارنة بالنظام السعودي إلى بيان الموانع التي تمنع القاضي من سماع الدعوى والحکم فيها. فمنها ما يتعلق بالقاضي، وذلک في حالات الغضب،
أو حصوله على رشوة، أو في حالة القضاء بعلمه، ومنها ما يتعلق بالخصوم في الدعوى، کأن يکون أحد الخصوم من أصول أو فرع أو حواشي القاضي، وکذلک ما يتعلق بشريک القاضي أو أجيره، أو عدوه أو صديقه.
  وتتنوع هذه الموانع إلى موانع النظر الوجوبية التي يمتنع على القاضي عند قيام أي سبب من أسبابها نظر الدعوى والحکم فيها، وإلا وقع حکمه باطلًا، وبين موانع النظر الجوازية التي تعرف برد القضاة، والتي يتعين أن يطلب أحد الخصوم إذا ما تحقق سبب من أسباب الرد أن يطلب رد القاضي، وإلا کان نظر القاضي للدعوى والحکم فيها صحيحًا. والتي وردت بنظام المرافعات الشرعية السعودي.
