الکليَّات الفقهية عند الإمام البغوي (ت516ه) (دراسة استقرائية)

هذا البحث بعنوان: الکليَّات الفقهية عند الإمام البغوي (ت516ه) (دراسة استقرائية)، يهدف إلى التَّعريف بحقيقة الکليات الفقهية وتمييزها عن غيرها بعد بيان التداخل بين مفهومها والقواعد الفقهية أو الضوابط الفقهية، وإظهار معالم من جهود الإمام البغوي (ت516ه) في تقريرها، وذلک من خلال جمع الکليات من کتب البغوي، وقد سلک الباحث منهج الاستقراء في جمع الکليات القائم على تتبع المسائل ثم إعادة عرضها، وقسَّم في عرض الکليات المجموعة على أمهات أبواب الفقه الکبرى: (العبادات، والمعاملات، والنکاح، والجنايات والقضاء)،وجعل الدراسة على مبحثين: الأول: حقيقة الکليات الفقهية والتعريف بدور الإمام البغوي في تقريرها. والثاني: الکليات الفقهية عند الإمام البغوي.
 وقد خلص لنتائج أهمها: احتواء الکتابين (التهذيب في الفقه) و(شرح السنة) على ثروة وافرة من الکليات الفقهية، وأهمية تکثيف الدراسات في موضوع الکليات الفقهية؛ التي لم تحظ بدراسات موسَّعة على نطاقات مذهبية شاملة.
This research is titled: Jurisprudential colleges of Al Imam Al Baghawi (died on 516 AH) (Inductive study), It aims to the identification of the truth of the jurisprudential colleges and distinguishing them from others after clarifying the overlap between their concept and jurisprudential rules or jurisprudential controls, and showing features of the efforts of Imam Al-Baghawi (died on 516 AH) in its report, and that is through collecting colleges from Al-Baghawi’s books, and the researcher followed the method of induction in collecting colleges based on tracking issues, then re-presenting them, and dividing in the presentation of the colleges collected to the references of the major chapters of jurisprudence: (acts of worship, transactions, marriage, crimes and the judiciary), and he made the study on two topics: The first: the truth of the jurisprudential colleges and the definition of the role of Imam Al-Baghawi in their determination. The second: the jurisprudential colleges according to Imam Al-Baghawi.
He concluded with the most important results: The two books (Al-Tahdheeb fil Fiqh) and (Explanation of Sunnah) contain an abundant wealth of jurisprudential colleges, and the importance of intensifying studies on the subject of jurisprudential colleges, which has not received extensive studies on comprehensive sectarian scales.
