تأديب الزوجة ضوابطه وأحکامه في الفقه الإسلامي

اشتمل هذا البحث على ثلاثة مباحث، المبحث الأول: معنى التأديب، ومراتبه، وحکمه، والمبحث الثاني: النصوص الواردة في تأديب الزوجة، والمبحث الثالث: ضوابط في تأديب الزوجة.
وقد تبيّن من خلال البحث أن الشرع الحنيف أباح للزوج تأديب زوجته عند الحاجة، وأن عامة الفقهاء اتفقوا على ذلک، وقد ذکر الله تعالى في کتابه أن التأديب يکون على مراتب ثلاث، أولها الوعظ، وثانيها الهجر، وثالثها الضرب غير المبرح، وقد اختلف الفقهاء في مشروعية تأديب الزوجة بالضرب، إذا قصرت في حقه، وذکر بعضهم أن الأولى ترکه، وجاءت السنة النبوية ببيان أن التأديب يجب أن يکون محاطاً بحدود معينة، وضوابط واضحة، وقد قرر تلک الضوابط علماء المسلمين، وأهمها، أن يکون التأديب بضرب الزوجة آخر مراحل التأديب، وأن يکون عند تحقق نشوزها، وأن يغلب على الظن کونه مفيداً، وذکروا أنه يکون في مخالفات محددة، وعند الحاجة، وأن لا يکثر منه الزوج، کما ذکروا أنه يجب أن يکون خفيفاً، وأن يکون في البيت فقط، وأن يکون في مواضع الجسد المأمونة، وأن يکون بآلة لا تؤذي، وأن يکون عشرة أسواط فأقل، وللفقهاء في هذه الضوابط تفصيلات وخلافات، ورد ذکرها في هذا البحث.
This research included three sections, the first topic: the meaning of discipline, its ranks, and its judgment, the second topic: the texts contained in disciplining the wife, and the third topic: controls in disciplining the wife.
And it has been shown through research that the true Sharia permits the husband to discipline his wife when needed, and that the general jurists have agreed on that. The legality of disciplining the wife by beating, if it falls short in his right, and some of them mentioned that the first is not it, and the Sunnah of the Prophet came with a statement that discipline must be surrounded by certain limits and clear controls. And that it is when it is realized, and that it is most likely to be useful, and they mentioned that it is in specific offenses, and when needed, and that the husband does not increase it, as they mentioned that it should be light, and be at home only, and be in safe places of the body, And that it be with a tool that does not harm, and that it be ten flaps or less, and the jurists regarding these controls have details and differences, which were mentioned in this research
