الأحکام الفقهية المتعلقة بوباء کورونا في المعاملات دراسة مقارنة

يتناول هذا البحث بيان الأحکام الفقهية المتعلقة بوباء کورونا في المعاملات، سواء کانت هذه المعاملات بعوض، أم بغير عوض، وقد قسمت هذا البحث إلى تمهيد ومبحثين، أما التمهيد فقد تناولت فيه بيان ماهية الوباء والفرق بينه وبين الطاعون.
أما المبحث الثاني فکان بعنوان الأحکام الفقهية المتعلقة بوباء کورونا في عقود المعاوضات، واقتصرت فيه على عقدين فقط هما عقد البيع، وعقد الإجارة، ولذا تم تقسيم هذا المبحث إلى فرعين، الفرع الأول کان بعنوان الأحکام الفقهية المتعلقة بوباء کورونا في عقد البيع، أما الفرع الثاني فتم تخصيصه لبيان الأحکام الفقهية المتعلقة بوباء کورونا في عقد الإجارة.
والمبحث الثاني من هذا البحث فتم تخصيصه لبيان الأحکام الفقهية المتعلقة بوباء کورونا في عقود التبرعات، وتم الاقتصار على عقدين من عقود التبرعات، أحدهما حال الحياة، وهو عقد الهبة، والثاني حال الموت، وهو عقد الوصية، ولذا تم تقسم هذا المبحث إلى فرعين، الفرع الأول تحت عنوان الأحکام الفقهية المتعلقة بوباء کورونا في عقد الهبة، أما الفرع الثاني فکان بعنوان الأحکام الفقهية المتعلقة بوباء کورونا في عقد الوصية.
أما الخاتمة فتناولت فيها أهم النتائج، والتوصيات والمراجع العلمية التي تم الاستعانة بها في هذا البحث.

Therefore, this topic was divided into two branches, the first section was titled the jurisprudential provisions related to the Corona epidemic in the sale contract, and the second branch It was dedicated to explaining the jurisprudential rulings related to the Corona epidemic in the lease contract. The second topic of this research was devoted to clarifying the jurisprudential rulings related to the Corona epidemic in donation contracts, and two decades of donation contracts were limited, one of which is the state of life, which is the donation contract, and the second is the case of death, which is the will contract, and therefore this topic was divided into two branches, the branch The first is under the heading of jurisprudential provisions related to the Corona epidemic in the contract of the gift, and the second section was under the title of jurisprudential provisions related to the Corona epidemic in the will contract. The conclusion deals with the most important findings, recommendations and scientific references that have been used in this research.
