القياس وأثره في المناسک دراسة تأصيلية تطبيقية

هذا البحث تناول دراسة" القياس وأثره في المناسک" ويهدف إلى: جمع بعض المسائل والتطبيقات في باب المناسک؛ لإثبات دور القياس في حلّ مشاکل بعض الحوادث والقضايا المتجددة في باب المناسک.
منهج البحث: سار البحث وفق المنهج التأصيلي التطبيقي، وجمع المادة العلمية من مصادرها وترتيبها حسب الأهمية، وجعلته في: مقدمة، وأربعة مباحث، وخاتمة، وفهارس.
وقد خلص في نهايته إلى: ذهب جماهير العلماء من السلف والخلف على أنّ القياس الصحيح حُجة شرعية معتبرة تثبت به الأحکام، وهو من الأدلة المتفق عليها، لا خلاف بين العلماء في أنه لا يجري القياس فيما لا يُعقل معناه من العبادات، ومحل الخلاف بينهم: المسائل التي لم ينص على حکمها بالقياس إذا کانت معقولة المعنى، فذهب جمهور الأصوليين إلى جوازه، خلافاً للحنفية، والراجح –والعلم عند الله – مذهب الجمهور؛ لقوة أدلتهم، القياس بشروطه وضوابطه له أثر کبير في العبادات، ومن ذلک " مناسک الحج مسائله ونوازله " وقد اتضح هذا جلياً من خلال التطبيقات.
This research deals with the study of "Measurement and its effect on rituals" and aims to: Collect some issues and applications in the chapter on rituals; To prove the role of measurement in solving the problems of some accidents and new issues in the door of the rituals.
Research methodology: The research proceeded according to the applied methodology, and collected scientific material from its sources and arranged them according to importance, and made it into: an introduction, four sections, a conclusion, and indexes.
In his conclusion, he concluded: The majority of scholars from the predecessors and successors said that the correct analogy is a valid legal argument in which the rulings are proven, and it is one of the evidence agreed upon. The ruling on analogy was not stipulated if the meaning was reasonable, so the majority of fundamentalists were of the view that it is permissible, unlike the Hanafi school, and the most correct - and knowledge is with God - is the view of the majority. Because of the strength of their evidence, analogy with its conditions and controls has a great impact on acts of worship, including “the rituals of Hajj, its issues and its consequences,” and this has been clearly demonstrated through the applications.
