القواعد الأصولية والفقهية في إعمال النص وسعة دلالته

أنزل الله الکتاب والسنة لهذه الأمة لمقاصد عظيمة من أهمها إعمال الآيات القرآينة والأحاديث النبوية بما تدل عليه من أحکام في العبادات والمعاملات وسائر الأحکام ..
وکان من معالم قدسية هذه النصوص وجوب إعمالها بل والسعة في الإعمال إن أمکن ذلک في النص القرآني أو النص النبوي
وکان من شأن العلماء الراسخين العناية بنصوص الشريعة لحملها على معان وفق مدلولاتها اللغوية والشرعية فکان من جهودهم وضع القواعد الأصولية والفقهية المنظمة لإعمال النصوص الشرعية بل والمتضمنة لما هو أبعد من هذا وهو السعة في دلالة النص الواحد
لقد حاولت في هذا البحث استقراء هذه القواعد فضمنته ثمان قواعد أصولية وثلاث قواعد فقهية تتضمن بمقتضاها الدلالي الحفاظ على النص من الإهمال بل والسعة في إعماله ما أمکن وبينت في کل قاعدة وجه أثرها في إعمال النص والسعة في دلالته مع الاستدلال والتمثيل ..
وکل هذا يبرهن على عظمة هذه الشريعة وعظمة نصوصها کما يبرهن على عظيم دور علماء الأمة في أثرهم في حفظ الدين رحمهم الله أجمعين.
Allah revealed the Quran and Sunnah to this ummah for great purposes. One of the most important of them is the implementation of the verses and the Hadiths, with what they indicate in terms of worship, dealing, and other provisions.
One of the hallmarks of the sanctity of these texts was the necessity to implement them, and to expand that if possible in the Quran or Hadith texts.
 Well-established scholars have paid attention to the texts of Sharia in order to understand them according to their linguistic and legal meanings, among their efforts; establishing the fundamentalist and jurisprudential rules governing the implementation of Sharia texts, rather, it includes what is beyond this, which is the broad significance of the text itself.
In this research, I tried to extrapolate these rules, so I included eight fundamentalist rules and three jurisprudential rules, which in their indicative meaning include preserving the text from neglect, and even implementing it as much as possible, I showed in each rule its impact on implementing the text, and expanding its significance with inference and reasoning by analogy.
All of these prove the greatness of this Sharia, the greatness of its texts, as well as the greatness of the role of the ummah’s scholars in their impact in preserving the religion, may Allah have mercy on them all.
