علم التقاسيم ودوره في دراسة الفقه- کتاب الطلاق أنموذجًا

هذه الدراسة عن موضوع مهم في دراساتنا الإنسانية عمومًا، وهو موضوع التقاسيم، الذي يهدف إلى ترتيب المسائل بشکل منطقي، ويُبنى على أساس تصور تلک المسائل بشکل هرمي، وهذه الطريقة مفيدة للمعلم والدارس على حد سواء؛ حيث تساعد المعلم على تبسيط المسائل ومساعدته في الشرح، وفيها اختصار للوقت والجهد، کما تساعد الدارس على فهم المسائل بشکل سلس ميسر، فتزيد من نشاطه وحماسه في الإقبال على العلم ودراسته.
 فکانت تلک الدراسة عن التقاسيم في علم الفقه، وبصفة أخص في کتاب الطلاق؛ لکثرة الجدل حوله وتشابک قضاياه، کما بينت علاقة علم التقاسيم بالعلوم الأخرى، مثل علم الفروق والأنواع والأشباه والنظائر، وخصصت للدراسة کتاب الطلاق من کتب الفقه، واعتمدت الدراسة على المنهج الاستقرائي الاستنباطي، باستقراء الکتب الفقهية، ومحاولة استنباط التقاسيم الموجودة في کتاب الطلاق، وما کان من خلاف بين الفقهاء في تلک التقاسيم بينته. وقد خرجت تلک الدراسة بنتيجة، وهي أهمية تعميم هذا العلم المعاصر على کل العلوم الشرعية والعربية؛ فيساعد على أخذه وفهمه.
This study is about an important topic in our human studies in general, which is the topic of Al taqasim, which aims to arrange issues in a logical manner, and is based on the perception of these issues in a hierarchical manner, and this method is useful for the teacher and the student alike. Where it helps the teacher to simplify the problems and help him in the explanation, and it reduces the time and effort, and helps the student to understand the issues in a smooth and easy way, thus increasing his activity and enthusiasm in the demand for science and its study.
 The present study tackles the science of division in Fiqh, and more specifically in the book of divorce. Because of the many controversies around it and the intertwining of his issues, as it showed the relationship of the science of Al-taqasim to other sciences, such as the “ilm Al-furuq, Al-anoiah, Al-ashbah and Al-nazair,
The study adopted the inductive-deductive approach by reviewing fiqh books and inducing the divisions in the Book of Divorce and the disagreement among scholars on these divisions. It concluded the importance of generalizing this contemporary science to all Sharia and Arabic sciences to promote their understanding.
