کتمان الرجعة وأثره في النکاح

إن عقد النکاح من أوثق العقود وأغلظها، سواء أکان ذلک في إنشائه وعقده، أم في حله ونقضه، أم في إعادته واستدامته، وإذا کان إنشاء عقد النکاح يقوم على إرادتين مستقلتين: إرادة الزوج أو من يقوم مقامه، وإرادة الولي أو من يقوم مقامه، فإن حَلَّه قد يکون بإرادة منفردة کما هو الحال في الطلاق، وقد يکون حَلُّه بإرادتين کما هو الحال في الخلع، وأما إعادته فقد يکون بإرادة مستقلة من الزوج کما إذا اختار الزوج الرجعة قبل انتهاء عدة الرجعية، وقد يکون بإرادتين کما هو الحال في رغبة الزوج بإرجاع الزوجة بعد انتهاء عدتها من طلاق رجعي، أو کان الطلاق على عوض، ولم يکتمل عدد الطلاق، ورغب الزوج في إعادة مطلقته أثناء العدة.
وإذا کانت الرجعة في الأصل تصح بإرادة منفردة من قبل الزوج، فإن ذلک لا يعني ترک أمر عقدها إلى الزوج دون ضوابط شرعية، تحقق ما مِنْ أجله شرعت الرجعة، وإن مما يقع فيه بعض الأزواج بعد طلاقهم لزوجاتهم
