القدح بالقلب عند الأصوليين وتطبيقه على روضة الناظر لابن قدامة دراسة تحليلية تطبيقية

إن من أهم المباحث في أصول الفقه العلة، وتعتبر القوادح وسيلة يعرف بها صحيح القياس من فاسده، والتي يجب على القائس أن يدفعها حتى يکون قياسه صحيحا.
ومن هذه القوادح قادح القلب وهو موضوع هذا البحث، ويهدف هذا البحث إلى إبراز مفهوم قادح القلب، بيان أنواعه عند الأصوليين، ودراسة حجيته تفصيلاً ونقداً، وأهم التطبيقات الفقهية لقادح القلب من خلال کتاب روضة الناظر.
وقد قسمت البحث إلى تمهيد وثلاثة مباحث: أما التمهيد: فهو تعريف القوادح وبيان أهميتها، وأما المبحث الأول: في تعريف القلب وأقسامه، المبحث الثاني: مذاهب الأصوليين في اعتبار القلب قادح من قوادح العلة، والمذهب الراجح، المبحث الثالث: أمثلة تطبيقية على قادح القلب من روضة الناظر لابن قدامة.
One of the most important investigations in the fundamentals of jurisprudence is the cause, and the trigger is considered a means by which the correct analogy is known from the corrupt, which the auditor must pay so that his measurement is correct.
One of these throttles is the heartbreaker, which is the subject of this research, and this research aims to highlight the concept of heartbreaker, explain its types to fundamentalists, study its argument in detail and critically, and the most important jurisprudential applications of heartbreaker through Rawdat al-Nazir book. The study was divided into an introduction and three sections: As for the introduction: it is the definition of triggers and their importance, and as for the first topic: in defining the heart and its divisions, the second topic: the doctrines of the fundamentalists regarding the consideration of the heart as one of the deflectors of the cause, and the most correct doctrine, the third topic: applied examples of the triggering of the heart From Kindergarten Al Nazer to Ibn Qudama.
