العوارض المؤثرة في تغير الفتوى

 البحث متعلق بمسألة مهمة وهي مسألة العوارض المؤثرة في تغير الفتى في الشريعة الإسلامية، لأنه من المقرر أن الشريعة الإسلامية – حفظها الله – راعت أحوال المکلفين وظروفهم وملابسات وقائعهم وأعرافهم ومآلات أفعالهم وما يترتب على أفعالهم من مصالح مفاسد، فلم تأت أحکام الشريعة مجرد قوالب جامدة لا يراع فيها الظروف التي تحيط بالمکلفين، بل على العکس من ذلک جاءت أحکام الشريعة مرنة واسعة تراعي أحوال المکلفين وما يحيط بهم من ظروف خاصة قد تجعل الفتوى الشرعية متغيرةً حسب هذه الظروف رعاية لهذه العوارض التي تطرأ على المکلفين، بل لعلي أن أذهب إلى ما هو أبعد من هذا فأقول إن النصوص الشرعية نفسها أنزلها الله –تعالى- باللغة العربية حتى تکون حمالة لأوجه متعددة يستطيع المجتهدون تفسيرها واستنباط أحکام متعددة من النص الواحد بما يلائم أحوال المکلفين .
ومن جملة الأشياء المؤثرة في تغير الفتوى هو تغير الزمان والمکان والأحوال والأعراف والمصالح والمآلات، فلهذه الأمور اعتبار في الفتيا، فما يصلح من فتيا في زمن أو مکان أو حال أو عرف قد لا يکون صالحاً عند تغير هذه الأمور، والواقع يؤيد ذلک ، وقد ورد في البحث أمثلة کثيرة على ذلک، وهذا في نظري أمدح ما مدحت به الشريعة الإسلامية أنها مرنة تسع بنصوصها وأحکامها وفتواها کل ما يعرض للمکلفين ويطرأ عليه التغير والاختلاف.
وقد استعمل الباحث المنهج الاستقرائي التحليلي في بيان علاقة هذه الأمور بالفتيا من حيث تغيرها بتغيرها، وتحليل ذلک تحليلا شرعياً مناسباً.
 وتوصل الباحث إلى عدة نتائج لعل أهمها: أن لهذه الأمور- الزمان والمکان والعرف والأحوال والمآلات- أثرها في تغير الفتوى، وصلاحية الشريعة الإسلامية للتطبيق في کل زمان ومکان، وأن الشريعة الإسلامية لم تضق يوماً ولن تضيق أن تسع الناس جميعاً على اختلاف ظروفهم وأحوالهم وأزمانهم وأماکنهم . والله أعلم
This research is related to an important issue which is the issue of the symptoms that affect the change of the boy in Islamic law, because it is planned that Islamic law - may God protect him - took into account the conditions of the taxpayers, their circumstances, the circumstances of their facts, their customs and the deeds of their actions, and the consequences of their actions that have spoilers. It does not take into account the circumstances surrounding the taxpayers,On the contrary, the provisions of the Sharia came in a wide, flexible way, taking into account the conditions of the taxpayers and the special circumstances surrounding them that might make the legal fatwa change according to these circumstances, in order to care for these symptoms that occur to the taxpayers. Allah Almighty has revealed it in Arabic so that it is a multi-faceted subject that the mujtahidin can explain and derive multiple provisions from the same text to suit the conditions of those charged with it.
Among the things that affect changing the fatwa is the change of time, place, conditions, customs, interests and interests, for these matters are regarded in the boys. The research has many examples of this, and this, in my view, praises what the Islamic Sharia praised as being flexible, seeking its texts, rulings, and fatwas, everything that is presented to the taxpayers and changes in it and difference.
The researcher used the inductive and analytical method to explain the relationship of these matters to the fatwa in terms of its change in its change, and the analysis of this is an appropriate legal analysis.
The researcher reached several results, perhaps the most important of them: that these matters - time, place, custom, conditions and fate - impact on changing the fatwa, and the validity of Islamic law to apply in every time and place, and that Islamic law has never narrowed and will not narrow that all people seek different conditions, conditions, times, and places .
