تقييد المطلق بالعُرف وأثره في الفروع الفقهية

بيَّنت الدراسة تقييد المطلق بالعرف وأثره في الفروع الفقهية، حقيقة العرف وأنواعه وبينت حکم تقييد المطلق بالعرف حيث إن علماء أصول الفقه لم يبحثوا مسألة تقييد المطلق بالعرف کما بحثوا تخصيص العام بالعرف.
إلا أن علماء أصول الفقه قد أجمع أکثرهم على تقييد المطلق بالعرف وخالف البعض ، وقد بينت الدراسة أدلة القائلين بتقييد المطلق بالعرف وأدلة المخالفين، وخلصت الدراسة إلى أن الجميع متفق على تقييد المطلق بالعرف وقد اتضح ذلک جلياً في تقييد الفقهاء للمطلق بالعرف في الفروع الفقهية ، مما بينته الدراسة في التطبيقات الفقهية
The study showed the restriction of the absolute to custom and its effect on the branches of jurisprudence, the reality of custom and its types, and the ruling on restricting the absolute to custom, as the scholars of the fundamentals of jurisprudence did not discuss restricting the absolute to custom, as they discussed specifying the general with custom. However, the scholars of Osul al-Fiqh most of them unanimously agreed to restrict the absolute to custom, and some disagreed. The study showed the evidence of those who say that the absolute is restricted to custom and the evidence of the violators.
