قادح الاستفسار عند الأصوليين دراسة تحليلية تطبيقية

يتناول هذا البحث قادح الاستفسار بالدراسة الأصولية التحليلية التطبيقية، ويأتي في قادح الاستفسار طليعة تلک القوادِح، وهو مِن أهمها وأعَمِّها، فإنه لا يختص بالقياس، فيرد على تقرير المدعى، وعلى جميع المقدِّمات، وعلى جميع الأدلة، فلا سؤال أعمّ منه.
ومن أهم أهداف هذا البحث توضيح قادح الاستفسار وتقريب فهمه للدّارسين من الناحية الأصولية والناحية التطبيقية.
وقد قسمت هذا البحث إلى تمهيد وخمس مباحث. تناولت في المبحث الأول مفهوم الاستفسار، والمبحث الثاني بينت فيه الخلاف في اعتبار الاستفسار قادحًا، موقع قادح الاستفسار من القوادح الأخرى. والمبحث الثالث بينت فيه کيفية الاعتراض بالاستفسار وما يجب على المعترض في القدح بالاستفسار. والمبحث الرابع بينت فيه کيفية الجواب عن قادح الاستفسار. وخصصت المبحث الخامس للتطبيقيات الفقهية لقادح الاستفسار.
 
This research deals with the inquiry trigger with a fundamental and applied analytical study, and in the inquiry triggerer comes the forefront of those triggerers, and it is one of the most important and broadest of them.
One of the most important objectives of this research is to clarify the trigger for inquiry and bring scholars closer to their understanding from a fundamentalist and practical point of view.
This research has been divided into preface and five sections. In the first section I dealt with the concept of inquiry, and in the second topic I showed the disagreement in considering the inquiry as a trigger, the location of the inquiry trigger from other triggers. And the third topic showed how to object by inquiry and what must be objected to slander by inquiry. And the fourth topic showed how to answer the inquiry trigger. The fifth section was devoted to the jurisprudential applications of the inquiry trigger.
