(قاعدة الأمور بمقاصدها والقواعد المندرجة تحتها)

إنَّ من أجل الأعمال العمل على نشر تراثنا الفقهي المجيد, والنّظر فيما کتبه المجتهدون الأوائل، وما أبدعته قرائحهم، وأسفرت عنه تأملاتهم ومقارناتهم، واستقراءاتهم في النصوص وغاياتها، وحکمة الشريعة ومقاصدها، من أجل إخضاع کل قضايا الحياة ولوازمها ومستجداتها لدين الله U, ودراسة الفقه الإسلامي لا تقوَى أسُسها إلا بتعميق البحث في أصوله وکليّاته وقواعده، وتطوير مناهج تقعيده، وربط مسائله وموضوعاته بضوابط وقواعد تنظم تفرعاته وتسهِّل حفظه, ومن هنا کانت رغبتي في کتابة بحث يجمع موضوعه بين الفقه وأصوله، فلمّا وجدت کثيرًا من مواضيع أصول الفقه قد دُرِسَتْ, وأُشبعت بحثًا، عمدت إلى علم قريب منه، عميق الجذور، وافر الأغصان، حلو الثمرات، يتسابق إليه طلاب العلم، ويتنافسون على موضوعاته؛ وهو علم القواعد والضوابط الفقهية، واستخلاصها من کتب السلف على مذهب معين أو إمام معين؛ فهو الأسلوب الوحيد لجمع مسائله المشتتة، وتسهيل مسالکه على الفقيه, وهو العمدة في ضبط أحکام النوازل المتشعبة، والقاعدة التي عليها الاستناد في مستجدات القضاء, والإفتاء المعقدّة. وهذا ما نبّه إليه الإمام القرافي-رحمه الله-؛ حيث جعلها موازية لأصول الفقه، وبين أنّهما معا يمثلان أصلين کبيرين من أصول الشريعة الإسلامية؛ فقال-رحمه الله-: "فإنَّ الشريعة المعظمة...اشتملت عل أصول وفروع وأصولها قسمان: أحدهما: المسمى أصول الفقه. والقسم الثاني: قواعد کلية فقهية جليلة، کثيرة العدد عظيمة القدر"؛ لذا عزمت-متوکلة على الله تعالى-على أن يکون عنوان بحثي: "قاعدة"الأمور بمقاصدها والقواعد المندرجة تحتها".
