حُکْمِ انْقِطَاعِ أَشْوَاطِ الطَّوَافِ دِرَاسَةٌ فِقْهِيَّة

اصْطفَى اللهُ I مکَّةَ مِن بينِ سائر البلدان, وأمرَ إبراهيمَ وإسماعيلَ u برفْعِ قواعدِ بيتِه العتيق؛  لإقامةِ شعائرِ الدِّين, ومِنْ أعْظمِ شعائرِ الدِّين التي فُرضت على جميع الأنبياء والمرسلين: شعيرةُ الحجِّ والطَّواف بالبيتِ العَتيقِ, فأصبحَ البيتُ قبلةً للمسلمين, ومَهْوًى لأفئدتِهم مُلَبِّين له وزائرين, والطَّوافُ شعيرةٌ ودعامةٌ يستندُ عليها مَنْسَکَا الحجِّ والعُمرةِ, ومعَ تَتابُع الزَّمانِ, وتَغَيُّرِ أحوالِ وأفعالِ المکلَّفين القاصِدِين للمسجد الحرام, وقعَتْ وقائِعُ, واسْتَجدَّتْ نَوازِلُ في أحکامِ الطَّواف, اسْتَدعَتِ اهتمامَ الباحثين؛ لمعرفة الحکم الشَّرعي فيها, فدعت الحاجة إلى معرفة حکم ذلک, ومَدى صحَّةِ الطَّواف. وتتَّضِحُ أهميّة الموضوع في أنَّ تمامَ الطَّوافِ وصِحَّتَه يَنبنِي عليه: تمامُ النُّسکِ وصِحَّتُه أيضًا, ولا يکادُ يَخلو بيتُ الله الحرام مِن الطَّائفين, ومعرفةُ الأحکامِ المترتبة على الطَّواف هو خدمةٌ للدِّين ولقاصدي بيتِ الله الحرام من الطَّائفين, وذلک بتقديمِ دراسات فقهيّةٍ تُجاهَ ما يستجِدُّ مِن وقائعَ ونوازلَ في أفعالِ المکلَّفين, وما زالت الحاجةُ قائمةً للدراسة ومعرفةِ أقوالِ الفقهاء في حکمِ انقطاعِ الأشواطِ, وبيانِ الأصولِ والفروعِ التي تمَّ تکييفُ النَّازلةِ عليها. وفي ضوءِ ذلک کان المنهجُ المتَّبعُ في دراسة المسألةِ هو المنهجُ التَّحليليُّ الوصفيًّ.
