تعطيل العمل بالحکم الشرعي "أزمة کورونا نموذجًا" دراسة تأصيلية تطبيقية

تعد قضية تعطيل العمل بالحکم الشرعي من القضايا المستجدة في أذهان الناس في هذه الأيام في ظل أزمة فيروس کورونا المستجد (covid19) الذي أصاب العالم ,  وأدي إلي الکثير من الموتي , والمصابين في بقاع العالم , ما بين مؤيد , ومعارض لذلک التعطيل , خاصة وقد انتصبت هيئات الإفتاء العالمية , للقول بإغلاق المساجد , وتعطيل صلاة الُجمع , والجماعات , وتعطيل مناسک العمرة , والحج , والطواف بالمسجد الحرام , وقامت الدول بتعطيل المواني , والملاحة الجوية , وتعطيل الدراسة بالجامعات , وتعطيل العمل , وغيرها من الأحکام , حفاظًا علي النفس البشرية من الهلاک , ورفعًا للمشقة عن العباد, ولا سيما أن کل ذلک بعد قرارات منظمة الصحة العالمية باعتبار فيروس کورونا المستجد وباء عالمي يؤدي إلي الهلاک , وأنه سريع النقل والانتشار بين الأفراد . ومن ينظر في تراثنا الفقهي يلاحظ أن کثير من الأحکام قد أُوقفت , وعطلت بسبب وجود المبررات , والمسوغات التي تقتضي ذلک التعطيل ,  فقد عطل سيدنا  عمر - رضي الله عنه – حد السرقة في الأزمات , والمجاعات, وقد عطل سهم المؤلفة قلوبهم أيضًا .  أما الهدف من هذا البحث فيتعلق بشقين مهمين : أما الشق الأول: فيتعلق بفکرة التعطيل ذاتها , حيث التعطيل قد مثل لغط کثير في أيامنا هذه بين المؤيدين, والمعارضين في قضية إغلاق المساجد , ووقف الصلوات , وتعطيل الجمع وغيرها من القضايا التي سأبينها, مما جعل لدي الحافز في بيان أصل هذه المصطلح , وموقف العلماء منه حيث أن علماء الأصول لم يتحدثوا عن هذا المصطلح کقضية مستقلة بذاتها بل جاء الحديث في ثنايا العرض لنظرية المصلحة وغيرها من القضايا .
وأما الثاني:  فيتعلق بالدراسة التطبيقية في ظل فيروس کورونا المستجد وما يتعلق به من أحکام , حيث جاء الجانب الفقهي علي شکل فتاوي , وقرارات من العلماء وهيئات الإفتاء , دون دراسة مستقلة تستوعب هذه النوازل , وکل الکتب والرسائل الجامعية قد تحدثت عن الأمراض المعدية , والأوبئة وما يتعلق بهما من أحکام أما هذه الدراسة فمقتصرة علي فيروس کورونا المستجد .  هذان العاملان جعل لدي الحافز الأکبر في السعي, والکتابة في هذه القضية من أجل بيان , وتأصيل قضية التعطيل عند العلماء من خلال الاستقراء في نصوص القرآن, والسنة مع مراعاة ذلک بنماذج تطبيقية منتشرة في ظل فيروس کورونا , وبيان أحکامها بالقياس علي ما شابهها من أعذار في الفقه الإسلامي.

The aim of this research is related to two important parts: As for the first part: it relates to the idea of ​​disrupting itself, where disruption has represented a lot of confusion in our days between supporters and opponents in the issue of closing mosques, stopping prayers, disrupting pluralism and other issues that I will explain, which made me motivated to explain the origin of this term, and the position of scholars From it, as the origins scholars did not talk about this term as an independent issue in itself, but the conversation came in the presentation of the theory of interest and other issues. As for the second: it relates to the applied study in light of the emerging Corona virus and related provisions, where the jurisprudential side came in the form of fatwas, and decisions from scholars and advisory bodies, without an independent study that accommodates these events, and all books and university theses have talked about infectious diseases, epidemics and what Related to them are two provisions. As for this study, it is limited to the emerging corona virus. These two factors made I have the greatest motivation in seeking, writing on this issue in order to explain, and establishing the issue of disruption among scholars through extrapolation in the texts of the Qur’an and the Sunnah, taking into account that there are applied models prevalent in the shadow of the Corona virus, and clarify its provisions by analogy with similar excuses in Islamic Fiqh.
