استقراء الأحداث التاريخية من کتب النوازل الفقهية ( سقوط الأندلس نموذجاً )

يتناول هذا البحث الأحداث التاريخية في أواخر العهد الأندلسي, والاضطهاد الذي تعرض له المسلمون في فترة السقوط إذ أدخلوا في الدين النصراني قهراً, والنوازل الفقهية التي حصلت لهم وتستلزم سؤال العلماء للبت فيها, ونعرض في هذا البحث ثلاثة نوازل, أولاً نازلة في أداء فريضة الصلاة في حال الإکراه, ثم سقوط فرض الحج عن أهل الأندلس لعدم الاستطاعة , وأخيراً  نازلة في الهجرة من بلاد الکفر فراراً إلى بلاد الإسلام. وتوصلت الدراسة إلى نتائج، أهمها: أهمية قراءة التاريخ وما مر به من حوادث فيها من العبر, حتى يستفيد منها أولي الألباب, لإسقاطها على الواقع. أهمية علم فقه النوازل في کل عصر, لتجدد المسائل التي لا غنى لها عنه. کما تتضح لنا قدرة الفقه الإسلامي وفعاليته لتقديم الحلول الناجحة التي تستجيب لواقع أي عصر ومستجداته. ودور العلماء في تثبيت أهل الأندلس على دينهم, من خلال إظهار الصورة السمحة للدين الإسلامي العظيم, وأن الله لا يکلفُ نفساً إلا وسعها. بالإضافة إلى عظمة الدين الإسلامي وسماحة مبادئه على الإنسانية, وأنه أعظم دين عرفته البشرية من حيث التکاليف وأن بعضها قد يصل إلى حد الإسقاط عند العجز.
This research deals with historical events in the late Andalusian era, and the persecution to which Muslims were subjected during the fall period, when they were forced into Christianity by force, and the jurisprudential calamities that occurred to them and necessitate asking the scholars to decide on them, and we present in this research three catastrophes, first coming down in performing the obligatory prayer in The state of coercion, then the imposition of the Hajj on behalf of the people of Andalusia fell due to the inability to, and finally coming down to emigration from the countries of infidelity to flee to the countries of Islam. The study reached results, the most important of which are: the importance of reading history and the incidents it has experienced in it, so that the first beneficiaries can benefit from it to bring it down to reality. The importance of the science of catastrophes in every age, to renew the issues that are essential. It is also clear to us the ability and effectiveness of Islamic jurisprudence to provide successful solutions that respond to the reality of any era and its developments. And the role of scholars in stabilizing the people of Andalusia on their religion, by showing the tolerant image of the great Islamic religion, and that God does not cost a soul except its power. In addition to the greatness of the Islamic religion and the tolerance of its principles over humanity, it is the greatest religion known to mankind in terms of costs, and some of them may amount to the projection of a deficiency.
